# §7483. Issuance of orders

- (a) **In general—** To effectuate the policy described in [section 7481(b) of this title](/usc/7/7481.md?p=b), the [Secretary](/usc/7/7482.md?p=14), subject to [subsection (b)](#b), shall issue 1 or more [orders](/usc/7/2902.md?p=10) applicable to [processors](/usc/7/7482.md?p=11). An [order](/usc/7/2902.md?p=10) shall be applicable to all [popcorn](/usc/7/7482.md?p=9) production and [marketing](/usc/7/7482.md?p=6) [areas](/usc/7/1471.md?p=5) in the [United States](/usc/7/7482.md?p=16). Not more than 1 [order](/usc/7/2902.md?p=10) shall be in effect under this subchapter at any 1 time.
- (b) **Procedure—**
  - (1) **Proposal or request for issuance—** The [Secretary](/usc/7/7482.md?p=14) may propose the issuance of an [order](/usc/7/2902.md?p=10), or an association of [processors](/usc/7/7482.md?p=11) or any other [person](/usc/7/7482.md?p=8) that would be affected by an [order](/usc/7/2902.md?p=10) may request the issuance of, and submit a proposal for, an [order](/usc/7/2902.md?p=10).
  - (2) **Notice and comment concerning proposed order—** Not later than 60 days after the receipt of a request and proposal for an [order](/usc/7/2902.md?p=10) under [paragraph (1)](#b-1), or at such time as the [Secretary](/usc/7/7482.md?p=14) determines to propose an [order](/usc/7/2902.md?p=10), the [Secretary](/usc/7/7482.md?p=14) shall publish a proposed [order](/usc/7/2902.md?p=10) and give due notice and opportunity for public comment on the proposed [order](/usc/7/2902.md?p=10).
  - (3) **Issuance of order—** After notice and opportunity for public comment under [paragraph (2)](#b-2), the [Secretary](/usc/7/7482.md?p=14) shall issue an [order](/usc/7/2902.md?p=10), taking into consideration the comments received and including in the [order](/usc/7/2902.md?p=10) such provisions as are necessary to ensure that the [order](/usc/7/2902.md?p=10) conforms to this subchapter. The [order](/usc/7/2902.md?p=10) shall be issued and become effective not later than 150 days after the date of publication of the proposed [order](/usc/7/2902.md?p=10).
- (c) **Amendments—** The [Secretary](/usc/7/7482.md?p=14), as appropriate, may amend an [order](/usc/7/2902.md?p=10). The provisions of this subchapter applicable to an [order](/usc/7/2902.md?p=10) shall be applicable to any amendment to an [order](/usc/7/2902.md?p=10), except that an amendment to an [order](/usc/7/2902.md?p=10) may not require a referendum to become effective.
