# §6404. Notice and comment


Not later than 60 days after the [Secretary](/usc/7/6402.md?p=7) receives a request for the issuance of an [order](/usc/7/2902.md?p=10) under this chapter, and a specific proposal for an [order](/usc/7/2902.md?p=10) from individual [fluid milk processors](/usc/7/6402.md?p=4) that marketed during a representative period, as determined by the [Secretary](/usc/7/6402.md?p=7), not less than 30 percent of the volume of [fluid milk products](/usc/7/6402.md?p=3) marketed by all [processors](/usc/7/609.md?p=d-7-D), the [Secretary](/usc/7/6402.md?p=7) shall publish the proposed [order](/usc/7/2902.md?p=10) and give due notice and opportunity for public comment on the proposed [order](/usc/7/2902.md?p=10).
