# §6103. Issuance of orders

- (a) **In general—** To effectuate the declared policy of [section 6101(b) of this title](/usc/7/6101.md?p=b), the [Secretary](/usc/7/6102.md?p=14), subject to the procedures provided in [subsection (b)](#b), shall issue [orders](/usc/7/2902.md?p=10) under this chapter applicable to [producers](/usc/7/6102.md?p=11), [importers](/usc/7/6102.md?p=6), and [first handlers](/usc/7/6102.md?p=5) of [mushrooms](/usc/7/6102.md?p=9). Any such [order](/usc/7/2902.md?p=10) shall be national in scope. Not more than one [order](/usc/7/2902.md?p=10) shall be in effect under this chapter at any one time.
- (b) **Procedures—**
  - (1) **Issuance of an order—** The [Secretary](/usc/7/6102.md?p=14) may propose the issuance of an [order](/usc/7/2902.md?p=10) under this chapter, or an association of mushroom [producers](/usc/7/6102.md?p=11) or any other [person](/usc/7/6102.md?p=10) that will be affected by this chapter may request the issuance of, and submit a proposal for, such an [order](/usc/7/2902.md?p=10).
  - (2) **Publication of order—** Not later than 60 days after the receipt of a request and proposal by an interested [person](/usc/7/6102.md?p=10) for an [order](/usc/7/2902.md?p=10), or when the [Secretary](/usc/7/6102.md?p=14) determines to propose an [order](/usc/7/2902.md?p=10), the [Secretary](/usc/7/6102.md?p=14) shall publish the proposed [order](/usc/7/2902.md?p=10) and give due notice and opportunity for public comment on the proposed [order](/usc/7/2902.md?p=10).
  - (3) **Issuance of order—** After notice and opportunity for public comment are given, as provided in [paragraph (2)](#b-2), the [Secretary](/usc/7/6102.md?p=14) shall issue the [order](/usc/7/2902.md?p=10), taking into consideration the comments received and including in the [order](/usc/7/2902.md?p=10) provisions necessary to ensure that the [order](/usc/7/2902.md?p=10) is in conformity with the requirements of this chapter. Such [order](/usc/7/2902.md?p=10) shall be issued and, if approved by [producers](/usc/7/6102.md?p=11) and [importers](/usc/7/6102.md?p=6) of [mushrooms](/usc/7/6102.md?p=9) as provided in [section 6105(a) of this title](/usc/7/6105.md?p=a), shall become effective not later than 180 days following publication of the proposed [order](/usc/7/2902.md?p=10).
- (c) **Amendments—**
  - (1) **In general—** The [Secretary](/usc/7/6102.md?p=14), from time to time, may amend any [order](/usc/7/2902.md?p=10) issued under this section.
  - (2) **Application of chapter—** The provisions of this chapter applicable to an [order](/usc/7/2902.md?p=10) shall be applicable to amendments to the [order](/usc/7/2902.md?p=10).
