# §3403. Issuance of orders

- (a) **Notice and hearing—** Whenever the [Secretary](/usc/7/3402.md?p=k) has reason to believe that the issuance of an [order](/usc/7/2902.md?p=10) will tend to effectuate the declared policy of this chapter, the [Secretary](/usc/7/3402.md?p=k) shall give due notice and opportunity for hearing upon a proposed [order](/usc/7/2902.md?p=10). Such hearing may be requested and proposal for an [order](/usc/7/2902.md?p=10) submitted by an organization certified pursuant to [section 3413 of this title](/usc/7/3413.md), or by any interested [person](/usc/7/3402.md?p=l) affected by the provisions of this chapter, including the [Secretary](/usc/7/3402.md?p=k).
- (b) **Effectuation of Congressional policy—** After notice and opportunity for hearing as provided in [subsection (a)](#a) of this section, the [Secretary](/usc/7/3402.md?p=k) shall issue an [order](/usc/7/2902.md?p=10) if the [Secretary](/usc/7/3402.md?p=k) finds, and sets forth in such [order](/usc/7/2902.md?p=10), upon the evidence introduced at such hearing that the issuance of such [order](/usc/7/2902.md?p=10) and all the terms and conditions thereof will tend to effectuate the declared policy of this chapter.
