# §2443. Initial appeal


When an application for [plant](/usc/7/8901.md?p=10) [variety](/usc/7/2401.md?p=a-10) protection has been refused by the [Plant](/usc/7/8901.md?p=10) [Variety](/usc/7/2401.md?p=a-10) Protection Office, the applicant may appeal to the Secretary. The Secretary shall seek the advice of the [Plant](/usc/7/8901.md?p=10) [Variety](/usc/7/2401.md?p=a-10) Protection [Board](/usc/7/1502.md?p=b-4) on all appeals, before deciding the appeal.
