# §2441. Examination of application


The Secretary shall cause an examination to be made of the application and if on such examination it is determined that the applicant is entitled to [plant](/usc/7/8901.md?p=10) [variety](/usc/7/2401.md?p=a-10) protection under the law, the Secretary shall issue a notice of allowance of [plant](/usc/7/8901.md?p=10) [variety](/usc/7/2401.md?p=a-10) protection therefor as hereinafter provided.
