# §1433a. Forgiveness of violations; determinations


Notwithstanding any other provision of law, whenever a [producer](/usc/7/6802.md?p=4-A-iii-III-bb) samples, turns, moves, or replaces [grain](/usc/7/75.md?p=g) or any other [commodity](/usc/7/1a.md?p=9) which is security for a [Commodity](/usc/7/1a.md?p=9) Credit [Corporation](/usc/7/1502.md?p=b-5) [producer](/usc/7/6802.md?p=4-A-iii-III-bb) loan or is held under a [producer](/usc/7/6802.md?p=4-A-iii-III-bb) reserve program, and does so in violation of law or regulation, the appropriate county [committee](/usc/7/2132.md?p=n) established under [section 590h(b) of title 16](/usc/16/590h.md?p=b) may forgive some or all of the penalties and requirements that would normally be imposed on the [producer](/usc/7/6802.md?p=4-A-iii-III-bb) by reason of the violation, if such [committee](/usc/7/2132.md?p=n) determines that (1) the violation occurred inadvertently or accidentally, because of lack of knowledge or understanding of the law or regulation, or because the [producer](/usc/7/6802.md?p=4-A-iii-III-bb) or the [producer](/usc/7/6802.md?p=4-A-iii-III-bb)’s agent acted to prevent spoilage of the [commodity](/usc/7/1a.md?p=9), and (2) the violation did not result in harm or damage to the rights or interests of any [person](/usc/7/1471g.md?p=b-1). The county [committee](/usc/7/2132.md?p=n) shall furnish a copy of its determination to the Administrator of the Agricultural Stabilization and Conservation Service and the appropriate [State](/usc/7/1359aa.md?p=5) [committee](/usc/7/2132.md?p=n) established under [section 590h(b) of title 16](/usc/16/590h.md?p=b). The determination may be disapproved by either the Administrator or the [State](/usc/7/1359aa.md?p=5) [committee](/usc/7/2132.md?p=n) within sixty days after receipt of a copy of the determination. Any determination not disapproved by the Administrator or such [State](/usc/7/1359aa.md?p=5) [committee](/usc/7/2132.md?p=n) within such sixty-day period shall be considered approved.
