# §8906a. Temporary employees

- (a)
  - (1) The Office of Personnel Management shall prescribe regulations to provide for offering [health benefits plans](/usc/5/8901.md?p=6) to temporary [employees](/usc/5/8901.md?p=1) (who meet the requirements of [paragraph (2)](#a-2)) under the provisions of this chapter.
  - (2) To be eligible to participate in a [health benefits plan](/usc/5/8901.md?p=6) offered under this section a temporary [employee](/usc/5/8901.md?p=1) shall have completed 1 year of current continuous employment, excluding any break in [service](/usc/5/8331.md?p=12) of 5 days or less.
- (b) Notwithstanding the provisions of [section 8906](/usc/5/8906.md)—
  - (1) any temporary [employee](/usc/5/8901.md?p=1) enrolled in a [health benefits plan](/usc/5/8901.md?p=6) under this section shall have an amount withheld from the pay of such [employee](/usc/5/8901.md?p=1), as determined by the Office of Personnel Management, equal to—
    - (A) the amount withheld from the pay of an [employee](/usc/5/8901.md?p=1) under the provisions of [section 8906](/usc/5/8906.md); and
    - (B) the amount of the [Government](/usc/5/8901.md?p=2) contribution for an [employee](/usc/5/8901.md?p=1) under [section 8906](/usc/5/8906.md); and
  - (2) the employing [agency](/usc/5/500.md?p=a-1) of any such temporary [employee](/usc/5/8901.md?p=1) shall not pay the [Government](/usc/5/8901.md?p=2) contribution under the provisions of [section 8906](/usc/5/8906.md).

Pub. L. 100–654, title III, § 301(d), Nov. 14, 1988, 102 Stat. 3847, provided that: “The amendments made by this section [enacting this section and amending section 8913 of this title] shall be effective 120 days after the date of enactment of this section [Nov. 14, 1988].”
