# §5757. Payment of expenses to obtain professional credentials

- (a) An [agency](/usc/5/500.md?p=a-1) may use appropriated funds or funds otherwise available to the [agency](/usc/5/500.md?p=a-1) to pay for—
  - (1) expenses for [employees](/usc/5/5361.md?p=1) to obtain professional credentials, including expenses for professional accreditation, State-imposed and professional licenses, and professional certification; and
  - (2) examinations to obtain such credentials.
- (b) The [authority](/usc/5/7103.md?p=a-6) under [subsection (a)](#a) may not be exercised on behalf of any [employee](/usc/5/5361.md?p=1) occupying or seeking to qualify for appointment to any [position](/usc/5/5531.md?p=2) that is excepted from the competitive [service](/usc/5/8331.md?p=12) because of the confidential, policy-determining, policy-making, or policy-advocating character of the [position](/usc/5/5531.md?p=2).
