# §9859e. Use of funds

- (a) **In general—** A [State](/usc/42/9859.md?p=4) that receives an allotment under [section 9859c of this title](/usc/42/9859c.md) shall use the [funds](/usc/42/12854.md?p=3) made available through the allotment to carry out two or more activities consisting of—
  - (1) providing [training](/usc/42/285e–2.md?p=b-2) and education to [eligible child care providers](/usc/42/9859.md?p=2) on preventing injuries and illnesses in [children](/usc/42/256e.md?p=g-2), and promoting health-related [practices](/usc/42/17061.md?p=19);
  - (2) strengthening licensing, regulation, or registration [standards](/usc/42/1320d.md?p=7) for [eligible child care providers](/usc/42/9859.md?p=2);
  - (3) assisting [eligible child care providers](/usc/42/9859.md?p=2) in meeting licensing, regulation, or registration [standards](/usc/42/1320d.md?p=7), including rehabilitating the [facilities](/usc/42/11049.md?p=4) of the providers, in order to bring the [facilities](/usc/42/11049.md?p=4) into compliance with the [standards](/usc/42/1320d.md?p=7);
  - (4) enforcing licensing, regulation, or registration [standards](/usc/42/1320d.md?p=7) for [eligible child care providers](/usc/42/9859.md?p=2), including holding increased unannounced [inspections](/usc/42/4851b.md?p=12) of the [facilities](/usc/42/11049.md?p=4) of those providers;
  - (5) providing health consultants to provide advice to [eligible child care providers](/usc/42/9859.md?p=2);
  - (6) assisting [eligible child care providers](/usc/42/9859.md?p=2) in enhancing the ability of the providers to serve [children](/usc/42/256e.md?p=g-2) with disabilities and infants and toddlers with disabilities;
  - (7) conducting criminal background checks for [eligible child care providers](/usc/42/9859.md?p=2) and other individuals who have contact with [children](/usc/42/256e.md?p=g-2) in the [facilities](/usc/42/11049.md?p=4) of the providers;
  - (8) providing information to [parents](/usc/42/1396a.md?p=k-3) on what factors to consider in choosing a safe and healthy [child](/usc/42/416.md?p=e) care setting; or
  - (9) assisting in improving the safety of transportation [practices](/usc/42/17061.md?p=19) for [children](/usc/42/256e.md?p=g-2) enrolled in [child](/usc/42/416.md?p=e) care [programs](/usc/42/274l–1.md?p=4) with [eligible child care providers](/usc/42/9859.md?p=2).
- (b) **Supplement, not supplant—** [Funds](/usc/42/12854.md?p=3) appropriated pursuant to the authority of this subchapter shall be used to supplement and not supplant other Federal, [State](/usc/42/9859.md?p=4), and local public [funds](/usc/42/12854.md?p=3) expended to provide services for [eligible individuals](/usc/42/239.md?p=a-6).
