# §9849. Nondiscrimination provisions

- (a) **Discrimination based on race, creed, color, etc., as basis for denial of financial assistance—** The [Secretary](/usc/42/9832.md?p=24) shall not provide [financial assistance](/usc/42/9832.md?p=5) for any [program](/usc/42/274l–1.md?p=4), [project](/usc/42/11360.md?p=20), or activity under this subchapter unless the grant or contract with respect thereto specifically provides that no [person](/usc/42/1320a–7k.md?p=d-4-C-i) with responsibilities in the operation thereof will discriminate with respect to any such [program](/usc/42/274l–1.md?p=4), [project](/usc/42/11360.md?p=20), or activity because of race, creed, color, national origin, sex, political affiliation, or beliefs.
- (b) **Sex discrimination; enforcement provisions applicable—** No [person](/usc/42/1320a–7k.md?p=d-4-C-i) in the [United States](/usc/42/403.md?p=k) shall on the ground of sex be excluded from participation in, be denied the benefits of, be subjected to discrimination under, or be denied employment in connection with any [program or activity](/usc/42/2000cc–5.md?p=6) receiving assistance under this subchapter. The [Secretary](/usc/42/9832.md?p=24) shall enforce the provisions of the preceding sentence in accordance with [section 2000d–1 of this title](/usc/42/2000d–1.md). [Section 2000d–2 of this title](/usc/42/2000d–2.md) shall apply with respect to any action taken by the [Secretary](/usc/42/9832.md?p=24) to enforce such sentence. This section shall not be construed as affecting any other legal remedy that a [person](/usc/42/1320a–7k.md?p=d-4-C-i) may have if such [person](/usc/42/1320a–7k.md?p=d-4-C-i) is excluded from participation in, denied the benefits of, subjected to discrimination under, or denied employment in connection with, any [program](/usc/42/274l–1.md?p=4), [project](/usc/42/11360.md?p=20), or activity receiving assistance under this subchapter.
- (c) **Discrimination based on handicapping condition as basis for denial of financial assistance—** The [Secretary](/usc/42/9832.md?p=24) shall not provide [financial assistance](/usc/42/9832.md?p=5) for any [program](/usc/42/274l–1.md?p=4), [project](/usc/42/11360.md?p=20), or activity under this subchapter unless the grant or contract relating to the [financial assistance](/usc/42/9832.md?p=5) specifically provides that no [person](/usc/42/1320a–7k.md?p=d-4-C-i) with responsibilities in the operation of the [program](/usc/42/274l–1.md?p=4), [project](/usc/42/11360.md?p=20), or activity will discriminate against any individual because of a handicapping condition in [violation](/usc/42/2000e–16a.md?p=c) of [section 794 of title 29](/usc/29/794.md).
