# §7384e. Establishment of Energy Employees Occupational Illness Compensation Fund

- (a) **Establishment—** There is hereby established on the books of the Treasury a [fund](/usc/42/12854.md?p=3) to be known as the “[Energy](/usc/42/6311.md?p=7) [Employees](/usc/42/1320a–7h.md?p=e-7) [Occupational Illness](/usc/42/7384l.md?p=15) Compensation [Fund](/usc/42/12854.md?p=3)” (in this subchapter referred to as the “compensation [fund](/usc/42/12854.md?p=3)”).
- (b) **Amounts in compensation fund—** The compensation [fund](/usc/42/12854.md?p=3) shall consist of the following amounts:
  - (1) Amounts appropriated to the compensation [fund](/usc/42/12854.md?p=3) pursuant to the [authorization](/usc/42/4370m.md?p=3) of appropriations in [section 7384g(b) of this title](/usc/42/7384g.md?p=b).
  - (2) Amounts transferred to the compensation [fund](/usc/42/12854.md?p=3) under [subsection (c)](#c).
- (c) **Financing of compensation fund—** Upon the exhaustion of amounts in the compensation [fund](/usc/42/12854.md?p=3) attributable to the [authorization](/usc/42/4370m.md?p=3) of appropriations in [section 7384g(b) of this title](/usc/42/7384g.md?p=b), the [Secretary](/usc/42/242q–4.md?p=2) of the Treasury shall transfer directly to the compensation [fund](/usc/42/12854.md?p=3) from the General [Fund](/usc/42/12854.md?p=3) of the Treasury, without further appropriation, such amounts as are further necessary to carry out the compensation [program](/usc/42/274l–1.md?p=4).
- (d) **Use of compensation fund—** Subject to [subsection (e)](#e), amounts in the compensation [fund](/usc/42/12854.md?p=3) shall be used to carry out the compensation [program](/usc/42/274l–1.md?p=4).
- (e) **Administrative costs not paid from compensation fund—** No cost incurred in carrying out the compensation [program](/usc/42/274l–1.md?p=4), or in administering the compensation [fund](/usc/42/12854.md?p=3), shall be paid from the compensation [fund](/usc/42/12854.md?p=3) or set off against or otherwise deducted from any payment to any individual under the compensation [program](/usc/42/274l–1.md?p=4).
- (f) **Investment of amounts in compensation fund—** Amounts in the compensation [fund](/usc/42/12854.md?p=3) shall be invested in accordance with [section 9702 of title 31](/usc/31/9702.md), and any interest on, and proceeds from, any such investment shall be credited to and become a part of the compensation [fund](/usc/42/12854.md?p=3).
