# §7384d. Establishment of Energy Employees Occupational Illness Compensation Program

- (a) **Program established—** There is hereby established a [program](/usc/42/274l–1.md?p=4) to be known as the “[Energy](/usc/42/6311.md?p=7) [Employees](/usc/42/1320a–7h.md?p=e-7) [Occupational Illness](/usc/42/7384l.md?p=15) Compensation [Program](/usc/42/274l–1.md?p=4)” (in this subchapter referred to as the “compensation [program](/usc/42/274l–1.md?p=4)”). The President shall carry out the compensation [program](/usc/42/274l–1.md?p=4) through one or more Federal agencies or officials, as designated by the President.
- (b) **Purpose of program—** The purpose of the compensation [program](/usc/42/274l–1.md?p=4) is to provide for timely, uniform, and adequate compensation of [covered employees](/usc/42/7384l.md?p=1) and, where applicable, survivors of such [employees](/usc/42/1320a–7h.md?p=e-7), suffering from illnesses incurred by such [employees](/usc/42/1320a–7h.md?p=e-7) in the performance of duty for the [Department of Energy](/usc/42/7384l.md?p=10) and certain of its contractors and subcontractors.
- (c) **Eligibility for compensation—** The eligibility of [covered employees](/usc/42/7384l.md?p=1) for compensation under the compensation [program](/usc/42/274l–1.md?p=4) shall be determined in accordance with the provisions of part B as may be [modified](/usc/42/7501.md?p=4) by a law enacted after the date of the submittal of the proposal for legislation required by [section 7384f of this title](/usc/42/7384f.md).
