# §4745. Government Service Fellowships

- (a) **Diverse payments—** The [Office](/usc/42/4762.md?p=1) is authorized to make grants to [State](/usc/42/4762.md?p=3) and general [local governments](/usc/42/4762.md?p=4) to support [programs](/usc/42/274l–1.md?p=4) approved by the [Office](/usc/42/4762.md?p=1) for providing Government Service [Fellowships](/usc/42/1862n–1.md?p=i-3) for [State](/usc/42/4762.md?p=3) and [local government](/usc/42/4762.md?p=4) personnel. The grants may cover—
  - (1) the necessary costs of the [fellowship](/usc/42/1862n–1.md?p=i-3) [recipient](/usc/42/2996a.md?p=6)’s books, travel, and transportation, and such related expenses as may be authorized by the [Office](/usc/42/4762.md?p=1);
  - (2) reimbursement to the [State](/usc/42/4762.md?p=3) or [local government](/usc/42/4762.md?p=4) for not to exceed one-fourth of the salary of each fellow during the period of the [fellowship](/usc/42/1862n–1.md?p=i-3); and
  - (3) payment to the educational institutions involved of such amounts as the [Office](/usc/42/4762.md?p=1) determines to be consistent with prevailing [practices](/usc/42/17061.md?p=19) under comparable federally supported [programs](/usc/42/274l–1.md?p=4) for each fellow, less any amount charged the fellow for tuition and nonrefundable fees and deposits.
- (b) **Period of fellowships; eligibility criteria—** [Fellowships](/usc/42/1862n–1.md?p=i-3) awarded under this section may not exceed two years of full-time graduate-level study for professional, administrative, and technical [employees](/usc/42/1320a–7h.md?p=e-7). The regulations of the [Office](/usc/42/4762.md?p=1) shall include eligibility criteria for the selection of [fellowship](/usc/42/1862n–1.md?p=i-3) [recipients](/usc/42/2996a.md?p=6) by [State](/usc/42/4762.md?p=3) and [local governments](/usc/42/4762.md?p=4).
- (c) **Selection of fellows; continuation of salary and employment benefits; public service plans upon completion of study: outline of plans in application for grant—** The [State](/usc/42/4762.md?p=3) or [local government](/usc/42/4762.md?p=4) concerned shall—
  - (1) select the individual [recipients](/usc/42/2996a.md?p=6) of the [fellowships](/usc/42/1862n–1.md?p=i-3);
  - (2) during the period of the [fellowship](/usc/42/1862n–1.md?p=i-3), continue the full salary of the [recipient](/usc/42/2996a.md?p=6) and normal employment benefits such as credit for seniority, leave accrual, retirement, and insurance; and
  - (3) make appropriate plans for the utilization and continuation in public service of [employees](/usc/42/1320a–7h.md?p=e-7) completing [fellowships](/usc/42/1862n–1.md?p=i-3) and outline such plans in the application for the grant.

### Transfer of Functions

“Office”, meaning Office of Personnel Management, substituted for “Commission”, meaning Civil Service Commission, in subsecs. (a) and (b) pursuant to Reorg. Plan No. 2 of 1978, § 102, 43 F.R. 36037, 92 Stat. 3783, set out under section 1101 of Title 5, Government Organization and Employees, which transferred functions vested by statute in Civil Service Commission and Chairman thereof to Director of Office of Personnel Management (except as otherwise specified), effective Jan. 1, 1979, as provided by section 1–102 of Ex. Ord. No. 12107, Dec. 28, 1978, 44 F.R. 1055, set out under section 1101 of Title 5.
