# §2005e. Definitions


As used in this subchapter:

- (a) “Hospital” includes [diagnostic or treatment centers](#b) and general hospitals, and [related facilities](/usc/42/1486.md?p=g-2), such as [laboratories](/usc/42/300jj.md?p=10), outpatient departments, nurses’ home and [training](/usc/42/285e–2.md?p=b-2) [facilities](/usc/42/11049.md?p=4), and central service [facilities](/usc/42/11049.md?p=4) operated in connection with hospitals, but does not include any hospital furnishing primarily domiciliary care;
- (b) “Diagnostic or treatment center” means a [facility](/usc/42/11049.md?p=4) for the diagnosis or diagnosis and [treatment](/usc/42/11851.md?p=11) of ambulatory patients—
  - (1) which is operated in connection with a [hospital](#a), or
  - (2) in which patient care is under the professional supervision of [persons](/usc/42/1320a–7k.md?p=d-4-C-i) licensed to practice medicine or surgery in the [State](/usc/42/201.md?p=f), or, in the case of dental diagnosis or [treatment](/usc/42/11851.md?p=11), under the professional supervision of [persons](/usc/42/1320a–7k.md?p=d-4-C-i) licensed to practice dentistry in the [State](/usc/42/201.md?p=f).
- (c) “Nonprofit” means owned or operated by one or more [corporations](/usc/42/2296b–7.md?p=1) or associations no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual.
- (d) “Construction” means construction of new [buildings](/usc/42/6881.md?p=i-3), expansion, remodeling, and alteration of existing [buildings](/usc/42/6881.md?p=i-3), and initial equipment of any such [buildings](/usc/42/6881.md?p=i-3) (including medical transportation [facilities](/usc/42/11049.md?p=4)), including architects and engineering fees, but excluding legal fees, the cost of off-site improvements and the cost of the acquisition of land.
