# §17032. Grants for biofuel production research and development in certain States

- (a) **In general—** The [Secretary](/usc/42/17001.md?p=3) shall provide grants to [eligible entities](/usc/42/296.md?p=1) for research, development, demonstration, and commercial application of biofuel production technologies in [States](/usc/42/201.md?p=f) with low rates of ethanol production, including low rates of production of cellulosic [biomass](/usc/42/16317.md?p=f-8-C) ethanol, as determined by the [Secretary](/usc/42/17001.md?p=3).
- (b) **Eligibility—** To be eligible to receive a grant under this section, an entity shall—
  - (1)
    - (A) be an [institution of higher education](/usc/42/17001.md?p=2) (as defined in [section 15801 of this title](/usc/42/15801.md)), including tribally controlled colleges or universities, located in a [State](/usc/42/201.md?p=f) described in [subsection (a)](#a); or
    - (B) be a [consortium](/usc/42/16282.md?p=d-4) including at least 1 such [institution of higher education](/usc/42/17001.md?p=2) and industry, [State agencies](/usc/42/1396r–8.md?p=k-9), [Indian](/usc/42/6862.md?p=6) tribal agencies, [National Laboratories](/usc/42/7381c–1.md?p=a-3), or [local government](/usc/42/8401a.md) agencies located in the [State](/usc/42/201.md?p=f); and
  - (2) have proven experience and capabilities with relevant technologies.
- (c) **Authorization of appropriations—** There are authorized to be appropriated to the [Secretary](/usc/42/17001.md?p=3) to carry out this section $25,000,000 for each of fiscal years 2008 through 2010.
