# §16280. Advanced Nuclear Energy Licensing Cost-Share Grant Program

- (a) **Definitions—** In this section:
  - (1) **Commission—** The term “Commission” means the Nuclear Regulatory Commission.
  - (2) **Program—** The term “program” means the Advanced Nuclear [Energy](/usc/42/6311.md?p=7) Cost-Share Grant Program established under [subsection (b)](#b).
  - (3) **Secretary—** The term “Secretary” means the Secretary of [Energy](/usc/42/6311.md?p=7).
- (b) **Establishment—** The [Secretary](#a-3) shall establish a grant [program](#a-2), to be known as the “Advanced Nuclear [Energy](/usc/42/6311.md?p=7) Cost-Share Grant [Program](#a-2)”, under which the [Secretary](#a-3) shall make cost-share grants to applicants for the purpose of funding a portion of the [Commission](#a-1) fees of the applicant for pre-application review activities and application review activities.
- (c) **Requirement—** The [Secretary](#a-3) shall seek out technology diversity in making grants under the [program](#a-2).
- (d) **Cost-share amount—** The [Secretary](#a-3) shall determine the cost-share amount for each grant under the [program](#a-2) in accordance with [section 16352 of this title](/usc/42/16352.md).
- (e) **Use of funds—** A [recipient](/usc/42/2996a.md?p=6) of a grant under the [program](#a-2) may use the [grant funds](/usc/42/5106a.md?p=f-1-B) to cover [Commission](#a-1) fees, including those fees associated with—
  - (1) developing a licensing [project](/usc/42/11360.md?p=20) plan;
  - (2) obtaining a statement of licensing feasibility;
  - (3) reviewing topical reports; and
  - (4) other—
    - (A) pre-application review activities;
    - (B) application review activities; and
    - (C) interactions with the [Commission](#a-1).
