# §14335. Limitations on sale of other mercuric-oxide batteries

- (a) **Prohibition—** On or after May 13, 1996, no [person](/usc/42/1320a–7k.md?p=d-4-C-i) shall sell, offer for sale, or offer for promotional purposes a [mercuric-oxide battery](/usc/42/14302.md?p=4) for use in the [United States](/usc/42/403.md?p=k) unless the battery [manufacturer](/usc/42/300aa–33.md?p=3), or the importer of such a battery—
  - (1) identifies a collection site in the [United States](/usc/42/403.md?p=k) that has all required Federal, [State](/usc/42/201.md?p=f), and [local government](/usc/42/8401a.md) approvals, to which [persons](/usc/42/1320a–7k.md?p=d-4-C-i) may send used [mercuric-oxide batteries](/usc/42/14302.md?p=4) for recycling or proper [disposal](/usc/42/2021b.md?p=7);
  - (2) informs each of its purchasers of [mercuric-oxide batteries](/usc/42/14302.md?p=4) of the collection site identified under [paragraph (1)](#a-1); and
  - (3) informs each of its purchasers of [mercuric-oxide batteries](/usc/42/14302.md?p=4) of a telephone number that the purchaser may call to get information about sending [mercuric-oxide batteries](/usc/42/14302.md?p=4) for recycling or proper [disposal](/usc/42/2021b.md?p=7).
- (b) **Application of section—** This section does not apply to a sale or offer of a mercuric-oxide [button cell](/usc/42/14302.md?p=2) battery.
