# §13367. Coal exports

- (a) **Plan—** Within 180 days after October 24, 1992, the [Secretary](/usc/42/13201.md) of [Commerce](/usc/42/6311.md?p=7), in cooperation with the [Secretary](/usc/42/13201.md) and other appropriate Federal agencies, shall submit to the appropriate committees of the House of [Representatives](/usc/42/3058f.md?p=5) and the Committee on [Energy](/usc/42/6311.md?p=7) and Natural Resources of the Senate a plan for expanding exports of coal mined in the [United States](/usc/42/403.md?p=k).
- (b) **Plan contents—** The plan submitted under [subsection (a)](#a) shall include—
  - (1) a description of the location, size, and projected growth in potential export markets for coal mined in the [United States](/usc/42/403.md?p=k);
  - (2) the identification by country of the foreign trade barriers to the export of coal mined in the [United States](/usc/42/403.md?p=k), including foreign coal production and utilization subsidies, tax [treatment](/usc/42/11851.md?p=11), labor [practices](/usc/42/17061.md?p=19), tariffs, quotas, and other nontariff barriers;
  - (3) recommendations and a plan for addressing any such trade barriers;
  - (4) an evaluation of existing infrastructure in the [United States](/usc/42/403.md?p=k) and any new infrastructure requirements in the [United States](/usc/42/403.md?p=k) to support an expansion of exports of coal mined in the [United States](/usc/42/403.md?p=k), including ports, vessels, rail lines, and any other supporting infrastructure; and
  - (5) an assessment of environmental implications of coal exports and the identification of export opportunities for blending coal mined in the [United States](/usc/42/403.md?p=k) with coal indigenous to other countries to enhance [energy efficiency](/usc/42/6291.md?p=5) and environmental performance.
