# §11432. Grants for State and local activities for the education of homeless children and youths

- (a) **General authority—** The [Secretary](/usc/42/11434a.md?p=4) is authorized to make grants to [States](/usc/42/11434a.md?p=5) in accordance with the provisions of this section to enable such [States](/usc/42/11434a.md?p=5) to carry out the activities described in [subsections (d) through (g)](#d..g).
- (b) **Grants from allotments—** The [Secretary](/usc/42/11434a.md?p=4) shall make the grants to [States](/usc/42/11434a.md?p=5) from the allotments made under [subsection (c)(1)](#c-1).
- (c) **Allocation and reservations—**
  - (1) **Allocation—**
    - (A) Subject to [subparagraph (B)](#c-1-B), the [Secretary](/usc/42/11434a.md?p=4) is authorized to allot to each [State](#c-3) an amount that bears the same ratio to the amount appropriated for such year under [section 11435 of this title](/usc/42/11435.md) that remains after the [Secretary](/usc/42/11434a.md?p=4) reserves [funds](/usc/42/12854.md?p=3) under [paragraph (2)](#c-2) and uses [funds](/usc/42/12854.md?p=3) to carry out section [11434(d)](/usc/42/11434.md?p=d) and [(h)](/usc/42/11434.md?p=h) of this title, as the amount allocated under section 1122 of the Elementary and Secondary Education Act of 1965 [[20 U.S.C. 6332](/usc/20/6332.md)] to the [State](#c-3) for that year bears to the total amount allocated under [section 1122](/usc/20/1122.md) of such Act to all [States](#c-3) for that year, except that no [State](#c-3) shall receive less than the greater of—
      - (i) $150,000;
      - (ii) one-fourth of 1 percent of the amount appropriated under [section 11435 of this title](/usc/42/11435.md) for that year; or
      - (iii) the amount such [State](#c-3) received under this section for fiscal year 2001.
    - (B) If there are insufficient [funds](/usc/42/12854.md?p=3) in a fiscal year to allot to each [State](#c-3) the minimum amount under [subparagraph (A)](#c-1-A), the [Secretary](/usc/42/11434a.md?p=4) shall ratably reduce the allotments to all [States](#c-3) based on the proportionate share that each [State](#c-3) received under this subsection for the preceding fiscal year.
  - (2) **Reservations—**
    - (A) The [Secretary](/usc/42/11434a.md?p=4) is authorized to reserve 0.1 percent of the amount appropriated for each fiscal year under [section 11435 of this title](/usc/42/11435.md) to be allocated by the [Secretary](/usc/42/11434a.md?p=4) among the [United States](/usc/42/403.md?p=k) Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands, according to their respective need for assistance under this part, as determined by the [Secretary](/usc/42/11434a.md?p=4).
    - (B)
      - (i) The [Secretary](/usc/42/11434a.md?p=4) shall transfer 1 percent of the amount appropriated for each fiscal year under [section 11435 of this title](/usc/42/11435.md) to the Department of the Interior for [programs](/usc/42/274l–1.md?p=4) for [Indian](/usc/42/6862.md?p=6) students served by [schools](/usc/42/6372.md?p=1) funded by the [Secretary](/usc/42/11434a.md?p=4) of the Interior, as determined under the [Indian](/usc/42/6862.md?p=6) Self-Determination and Education Assistance Act ([25 U.S.C. 450](/usc/25/450.md) et seq.),[^1] that are consistent with the purposes of the [programs](/usc/42/274l–1.md?p=4) described in this part.
      - (ii) The [Secretary](/usc/42/11434a.md?p=4) and the [Secretary](/usc/42/11434a.md?p=4) of the Interior shall enter into an [agreement](/usc/42/1320b–8.md?p=a-3-A), consistent with the requirements of this part, for the distribution and use of the [funds](/usc/42/12854.md?p=3) described in [clause (i)](#c-2-B-i) under terms that the [Secretary](/usc/42/11434a.md?p=4) determines best meet the purposes of the [programs](/usc/42/274l–1.md?p=4) described in this part. Such [agreement](/usc/42/1320b–8.md?p=a-3-A) shall set forth the plans of the [Secretary](/usc/42/11434a.md?p=4) of the Interior for the use of the amounts transferred, including appropriate goals, objectives, and milestones.
  - (3) **State defined—** For purposes of this subsection, the term “State” does not include the [United States](/usc/42/403.md?p=k) Virgin Islands, Guam, American Samoa, or the Commonwealth of the Northern Mariana Islands.
- (d) **Activities—** Grants under this section shall be used for the following:
  - (1) To carry out the policies set forth in [section 11431 of this title](/usc/42/11431.md) in the [State](/usc/42/11434a.md?p=5).
  - (2) To provide services and activities to improve the identification of [homeless children and youths](/usc/42/11434a.md?p=2) (including preschool-aged [homeless children](/usc/42/9832.md?p=11)) and enable such [children](/usc/42/256e.md?p=g-2) and youths to [enroll](/usc/42/11434a.md?p=1) in, attend, and succeed in [school](/usc/42/6372.md?p=1), including, if appropriate, in preschool [programs](/usc/42/274l–1.md?p=4).
  - (3) To establish or designate in the [State educational agency](/usc/42/11434a.md?p=3) an [Office](/usc/42/3058f.md?p=1) of the Coordinator for Education of [Homeless Children and Youths](/usc/42/11434a.md?p=2) that can sufficiently carry out the duties described for the [Office](/usc/42/3058f.md?p=1) in this part in accordance with [subsection (f)](#f).
  - (4) To prepare and carry out the [State](/usc/42/11434a.md?p=5) plan described in [subsection (g)](#g).
  - (5) To develop and implement professional development [programs](/usc/42/274l–1.md?p=4) for liaisons designated under [subsection (g)(1)(J)(ii)](#g-1-J-ii) and other [local educational agency](/usc/42/11434a.md?p=3) personnel—
    - (A) to improve their identification of [homeless children and youths](/usc/42/11434a.md?p=2); and
    - (B) to heighten the awareness of the liaisons and personnel of, and their capacity to respond to, specific needs in the education of [homeless children and youths](/usc/42/11434a.md?p=2).
- (e) **State and local subgrants—**
  - (1) **Minimum disbursements by States—** From the sums made available each year to a [State](/usc/42/11434a.md?p=5) through grants under [subsection (a)](#a) to carry out this part, the [State educational agency](/usc/42/11434a.md?p=3) shall distribute not less than 75 percent in subgrants to [local educational agencies](/usc/42/11434a.md?p=3) for the purposes of carrying out [section 11433 of this title](/usc/42/11433.md), except that [States](/usc/42/11434a.md?p=5) funded at the minimum level set forth in [subsection (c)(1)](#c-1) shall distribute not less than 50 percent in subgrants to [local educational agencies](/usc/42/11434a.md?p=3) for the purposes of carrying out [section 11433 of this title](/usc/42/11433.md).
  - (2) **Use by State educational agency—** A [State educational agency](/usc/42/11434a.md?p=3) may use the [grant funds](/usc/42/5106a.md?p=f-1-B) remaining after the [State educational agency](/usc/42/11434a.md?p=3) distributes subgrants under [paragraph (1)](#e-1) to conduct activities under [subsection (f)](#f) directly or through grants or contracts.
  - (3) **Prohibition on segregating homeless students—**
    - (A) **In general—** Except as provided in [subparagraph (B)](#e-3-B) and [section 11433(a)(2)(B)(ii) of this title](/usc/42/11433.md?p=a-2-B-ii), in providing a free public education to a [homeless](/usc/42/11302.md?p=a) [child](/usc/42/416.md?p=e) or youth, no [State](/usc/42/11434a.md?p=5) receiving [funds](/usc/42/12854.md?p=3) under this part shall segregate such [child](/usc/42/416.md?p=e) or youth in a separate [school](/usc/42/6372.md?p=1), or in a separate [program](/usc/42/274l–1.md?p=4) within a [school](/usc/42/6372.md?p=1), based on such [child](/usc/42/416.md?p=e)’s or youth’s status as [homeless](/usc/42/11302.md?p=a).
    - (B) **Exception—** Notwithstanding [subparagraph (A)](#e-3-A), paragraphs [(1)(J)(i)](#g-1-J-i) and [(3)](#g-3) of subsection (g), [section 11433(a)(2) of this title](/usc/42/11433.md?p=a-2), and any other provision of this part relating to the placement of [homeless children or youths](/usc/42/290bb–7a.md?p=c-2-D) in [schools](/usc/42/6372.md?p=1), a [State](/usc/42/11434a.md?p=5) that has a separate [school](/usc/42/6372.md?p=1) for [homeless children or youths](/usc/42/290bb–7a.md?p=c-2-D) that was operated in fiscal year 2000 in a [covered county](#e-3-G) shall be eligible to receive [funds](/usc/42/12854.md?p=3) under this part for [programs](/usc/42/274l–1.md?p=4) carried out in such [school](/usc/42/6372.md?p=1) if—
      - (i) the [school](/usc/42/6372.md?p=1) meets the requirements of [subparagraph (C)](#e-3-C);
      - (ii) any [local educational agency](/usc/42/11434a.md?p=3) serving a [school](/usc/42/6372.md?p=1) that the [homeless children and youths](/usc/42/11434a.md?p=2) enrolled in the separate [school](/usc/42/6372.md?p=1) are eligible to attend meets the requirements of [subparagraph (E)](#e-3-E); and
      - (iii) the [State](/usc/42/11434a.md?p=5) is otherwise eligible to receive [funds](/usc/42/12854.md?p=3) under this part.
    - (C) **School requirements—** For the [State](/usc/42/11434a.md?p=5) to be eligible under [subparagraph (B)](#e-3-B) to receive [funds](/usc/42/12854.md?p=3) under this part, the [school](/usc/42/6372.md?p=1) described in such subparagraph shall—
      - (i) provide written notice, at the time any [child](/usc/42/416.md?p=e) or youth seeks [enrollment](/usc/42/11434a.md?p=1) in such [school](/usc/42/6372.md?p=1), and at least twice annually while the [child](/usc/42/416.md?p=e) or youth is enrolled in such [school](/usc/42/6372.md?p=1), to the [parent](/usc/42/1396a.md?p=k-3) or guardian of the [child](/usc/42/416.md?p=e) or youth (or, in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6), the youth) that—
        - (I) shall be signed by the [parent](/usc/42/1396a.md?p=k-3) or guardian (or, in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6), the youth);
        - (II) sets forth the general rights provided under this part;
        - (III) specifically [states](/usc/42/11434a.md?p=5)—
          - (aa) the choice of [schools](/usc/42/6372.md?p=1) [homeless children and youths](/usc/42/11434a.md?p=2) are eligible to attend, as provided in [subsection (g)(3)(A)](#g-3-A);
          - (bb) that no [homeless](/usc/42/11302.md?p=a) [child](/usc/42/416.md?p=e) or youth is required to attend a separate [school](/usc/42/6372.md?p=1) for [homeless children or youths](/usc/42/290bb–7a.md?p=c-2-D);
          - (cc) that [homeless children and youths](/usc/42/11434a.md?p=2) shall be provided comparable services described in [subsection (g)(4)](#g-4), including transportation services, educational services, and meals through [school](/usc/42/6372.md?p=1) meals [programs](/usc/42/274l–1.md?p=4); and
          - (dd) that [homeless children and youths](/usc/42/11434a.md?p=2) should not be stigmatized by [school](/usc/42/6372.md?p=1) personnel; and
        - (IV) provides contact information for the local liaison for [homeless children and youths](/usc/42/11434a.md?p=2) and the [State](/usc/42/11434a.md?p=5) Coordinator for Education of [Homeless Children and Youths](/usc/42/11434a.md?p=2);
      - (ii)
        - (I) provide assistance to the [parent](/usc/42/1396a.md?p=k-3) or guardian of each [homeless](/usc/42/11302.md?p=a) [child](/usc/42/416.md?p=e) or youth (or, in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6), the youth) to exercise the right to attend the [parent](/usc/42/1396a.md?p=k-3)’s or guardian’s (or youth’s) choice of [schools](/usc/42/6372.md?p=1), as provided in [subsection (g)(3)(A)](#g-3-A); and
        - (II) coordinate with the [local educational agency](/usc/42/11434a.md?p=3) with jurisdiction for the [school](/usc/42/6372.md?p=1) selected by the [parent](/usc/42/1396a.md?p=k-3) or guardian (or youth), to provide transportation and other necessary services;
      - (iii) ensure that the [parent](/usc/42/1396a.md?p=k-3) or guardian (or, in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6), the youth) shall receive the information required by this subparagraph in a manner and form understandable to such [parent](/usc/42/1396a.md?p=k-3) or guardian (or youth), including, if necessary and to the extent feasible, in the native language of such [parent](/usc/42/1396a.md?p=k-3) or guardian (or youth); and
      - (iv) demonstrate in the [school](/usc/42/6372.md?p=1)’s application for [funds](/usc/42/12854.md?p=3) under this part that such [school](/usc/42/6372.md?p=1)—
        - (I) is complying with clauses [(i)](#e-3-C-i) and [(ii)](#e-3-C-ii); and
        - (II) is meeting (as of the date of submission of the application) the same Federal and [State](/usc/42/11434a.md?p=5) [standards](/usc/42/1320d.md?p=7), regulations, and mandates as other public [schools](/usc/42/6372.md?p=1) in the [State](/usc/42/11434a.md?p=5) (such as complying with [section 1111](/usc/42/1111.md) of the Elementary and Secondary Education Act of 1965 [[20 U.S.C. 6311](/usc/20/6311.md)] and providing a full range of education and related services, including services applicable to students with disabilities).
    - (D) **School ineligibility—** A separate [school](/usc/42/6372.md?p=1) described in [subparagraph (B)](#e-3-B) that fails to meet the [standards](/usc/42/1320d.md?p=7), regulations, and mandates described in [subparagraph (C)(iv)(II)](#e-3-C-iv-II) shall not be eligible to receive [funds](/usc/42/12854.md?p=3) under this part for [programs](/usc/42/274l–1.md?p=4) carried out in such [school](/usc/42/6372.md?p=1) after the first date of such failure.
    - (E) **Local educational agency requirements—** For the [State](/usc/42/11434a.md?p=5) to be eligible to receive the [funds](/usc/42/12854.md?p=3) described in [subparagraph (B)](#e-3-B), the [local educational agency](/usc/42/11434a.md?p=3) described in [subparagraph (B)(ii)](#e-3-B-ii) shall—
      - (i) implement a coordinated system for ensuring that [homeless children and youths](/usc/42/11434a.md?p=2)—
        - (I) are advised of the choice of [schools](/usc/42/6372.md?p=1) provided in [subsection (g)(3)(A)](#g-3-A);
        - (II) are immediately enrolled, in accordance with [subsection (g)(3)(C)](#g-3-C), in the [school](/usc/42/6372.md?p=1) selected under [subsection (g)(3)(A)](#g-3-A); and
        - (III) are promptly provided necessary services described in [subsection (g)(4)](#g-4), including transportation, to allow [homeless children and youths](/usc/42/11434a.md?p=2) to exercise their choices of [schools](/usc/42/6372.md?p=1) under [subsection (g)(3)(A)](#g-3-A);
      - (ii) document that written notice has been provided—
        - (I) in accordance with [subparagraph (C)(i)](#e-3-C-i) for each [child](/usc/42/416.md?p=e) or youth enrolled in a separate [school](/usc/42/6372.md?p=1) under [subparagraph (B)](#e-3-B); and
        - (II) in accordance with [subsection (g)(6)(A)(vi)](#g-6-A-vi);
      - (iii) prohibit [schools](/usc/42/6372.md?p=1) within the agency’s jurisdiction from referring [homeless children or youths](/usc/42/290bb–7a.md?p=c-2-D) to, or requiring [homeless children and youths](/usc/42/11434a.md?p=2) to [enroll](/usc/42/11434a.md?p=1) in or attend, a separate [school](/usc/42/6372.md?p=1) described in [subparagraph (B)](#e-3-B);
      - (iv) identify and [remove](/usc/42/9601.md?p=23) any barriers that exist in [schools](/usc/42/6372.md?p=1) within the agency’s jurisdiction that may have contributed to the creation or existence of separate [schools](/usc/42/6372.md?p=1) described in [subparagraph (B)](#e-3-B); and
      - (v) not use [funds](/usc/42/12854.md?p=3) received under this part to establish—
        - (I) new or additional separate [schools](/usc/42/6372.md?p=1) for [homeless children or youths](/usc/42/290bb–7a.md?p=c-2-D); or
        - (II) new or additional sites for separate [schools](/usc/42/6372.md?p=1) for [homeless children or youths](/usc/42/290bb–7a.md?p=c-2-D), other than the sites occupied by the [schools](/usc/42/6372.md?p=1) described in [subparagraph (B)](#e-3-B) in fiscal year 2000.
    - (F) **Report—**
      - (i) **Preparation—** The [Secretary](/usc/42/11434a.md?p=4) shall prepare a report on the separate [schools](/usc/42/6372.md?p=1) and [local educational agencies](/usc/42/11434a.md?p=3) described in [subparagraph (B)](#e-3-B) that receive [funds](/usc/42/12854.md?p=3) under this part in accordance with this paragraph. The report shall contain, at a minimum, information on—
        - (I) compliance with all requirements of this paragraph;
        - (II) barriers to [school](/usc/42/6372.md?p=1) access in the [school](/usc/42/6372.md?p=1) districts served by the [local educational agencies](/usc/42/11434a.md?p=3);
        - (III) the progress the separate [schools](/usc/42/6372.md?p=1) are making in integrating [homeless children and youths](/usc/42/11434a.md?p=2) into the mainstream [school](/usc/42/6372.md?p=1) environment, including the average length of student [enrollment](/usc/42/11434a.md?p=1) in such [schools](/usc/42/6372.md?p=1); and
        - (IV) the progress the separate [schools](/usc/42/6372.md?p=1) are making in helping all students meet the challenging [State](/usc/42/11434a.md?p=5) academic [standards](/usc/42/1320d.md?p=7).
      - (ii) **Compliance with information requests—** For purposes of enabling the [Secretary](/usc/42/11434a.md?p=4) to prepare the report, the separate [schools](/usc/42/6372.md?p=1) and [local educational agencies](/usc/42/11434a.md?p=3) shall cooperate with the [Secretary](/usc/42/11434a.md?p=4) and the [State](/usc/42/11434a.md?p=5) Coordinator for Education of [Homeless Children and Youths](/usc/42/11434a.md?p=2) established in the [State](/usc/42/11434a.md?p=5) under [subsection (d)(3)](#d-3), and shall comply with any requests for information by the [Secretary](/usc/42/11434a.md?p=4) and [State](/usc/42/11434a.md?p=5) Coordinator for such [State](/usc/42/11434a.md?p=5).
      - (iii) **Submission—** The [Secretary](/usc/42/11434a.md?p=4) shall submit the report described in [clause (i)](#e-3-F-i) to—
        - (I) the President;
        - (II) the Committee on Education and the Workforce of the House of [Representatives](/usc/42/3058f.md?p=5); and
        - (III) the Committee on Health, Education, Labor, and Pensions of the Senate.
    - (G) **Definition—** For purposes of this paragraph, the term “covered county” means—
      - (i) San Joaquin County, California;
      - (ii) Orange County, California;
      - (iii) San Diego County, California; and
      - (iv) Maricopa County, Arizona.
- (f) **Functions of the Office of the Coordinator—** The Coordinator for Education of [Homeless Children and Youths](/usc/42/11434a.md?p=2) established in each [State](/usc/42/11434a.md?p=5) shall—
  - (1) gather and make publicly available reliable, valid, and comprehensive information on—
    - (A) the number of [homeless children and youths](/usc/42/11434a.md?p=2) identified in the [State](/usc/42/11434a.md?p=5), which shall be posted annually on the [State educational agency](/usc/42/11434a.md?p=3)’s website;
    - (B) the nature and extent of the problems [homeless children and youths](/usc/42/11434a.md?p=2) have in gaining access to public preschool [programs](/usc/42/274l–1.md?p=4) and to public elementary [schools](/usc/42/6372.md?p=1) and secondary [schools](/usc/42/6372.md?p=1);
    - (C) the difficulties in identifying the special needs and barriers to the participation and achievement of such [children](/usc/42/256e.md?p=g-2) and youths;
    - (D) any progress made by the [State educational agency](/usc/42/11434a.md?p=3) and [local educational agencies](/usc/42/11434a.md?p=3) in the [State](/usc/42/11434a.md?p=5) in addressing such problems and difficulties; and
    - (E) the success of the [programs](/usc/42/274l–1.md?p=4) under this part in identifying [homeless children and youths](/usc/42/11434a.md?p=2) and allowing such [children](/usc/42/256e.md?p=g-2) and youths to [enroll](/usc/42/11434a.md?p=1) in, attend, and succeed in, [school](/usc/42/6372.md?p=1);
  - (2) develop and carry out the [State](/usc/42/11434a.md?p=5) plan described in [subsection (g)](#g);
  - (3) collect data for and transmit to the [Secretary](/usc/42/11434a.md?p=4), at such time and in such manner as the [Secretary](/usc/42/11434a.md?p=4) may reasonably require, a report containing information necessary to assess the educational needs of [homeless children and youths](/usc/42/11434a.md?p=2) within the [State](/usc/42/11434a.md?p=5), including data necessary for the [Secretary](/usc/42/11434a.md?p=4) to fulfill the responsibilities under [section 11434(h) of this title](/usc/42/11434.md?p=h);
  - (4) in order to improve the provision of comprehensive education and related services to [homeless children and youths](/usc/42/11434a.md?p=2) and their [families](/usc/42/12704.md?p=11), coordinate activities and collaborate with—
    - (A) educators, including teachers, special education personnel, [administrators](/usc/42/4005.md?p=1), and [child](/usc/42/416.md?p=e) development and preschool [program](/usc/42/274l–1.md?p=4) personnel;
    - (B) providers of services to [homeless children and youths](/usc/42/11434a.md?p=2) and their [families](/usc/42/12704.md?p=11), including public and private [child](/usc/42/416.md?p=e) welfare and social services agencies, law enforcement agencies, juvenile and [family](/usc/42/290ff–4.md?p=d-2) courts, agencies providing mental health services, [domestic violence](/usc/42/10402.md?p=3) agencies, [child](/usc/42/416.md?p=e) care providers, runaway and [homeless youth](/usc/42/290bb–7a.md?p=c-2-D) centers, and providers of services and [programs](/usc/42/274l–1.md?p=4) funded under the Runaway and Homeless Youth Act ([42 U.S.C. 5701](/usc/42/5701.md) et seq.);[^1]
    - (C) providers of emergency, transitional, and permanent [housing](/usc/42/1490p–2.md?p=r-3) to [homeless children and youths](/usc/42/11434a.md?p=2), and their [families](/usc/42/12704.md?p=11), including [public housing agencies](/usc/42/8012.md?p=g-5), shelter operators, operators of transitional [housing](/usc/42/1490p–2.md?p=r-3) [facilities](/usc/42/11049.md?p=4), and providers of transitional living [programs](/usc/42/274l–1.md?p=4) for [homeless youths](/usc/42/290bb–7a.md?p=c-2-D);
    - (D) [local educational agency](/usc/42/11434a.md?p=3) liaisons designated under [subsection (g)(1)(J)(ii)](#g-1-J-ii) for [homeless children and youths](/usc/42/11434a.md?p=2); and
    - (E) community organizations and groups representing [homeless children and youths](/usc/42/11434a.md?p=2) and their [families](/usc/42/12704.md?p=11);
  - (5) provide technical assistance to and conduct monitoring of [local educational agencies](/usc/42/11434a.md?p=3) in coordination with [local educational agency](/usc/42/11434a.md?p=3) liaisons designated under [subsection (g)(1)(J)(ii)](#g-1-J-ii), to ensure that [local educational agencies](/usc/42/11434a.md?p=3) comply with the requirements of [subsection (e)(3)](#e-3) and [paragraphs (3) through (7)](#g-3..g-7) of subsection (g);
  - (6) provide professional development opportunities for [local educational agency](/usc/42/11434a.md?p=3) personnel and the [local educational agency](/usc/42/11434a.md?p=3) liaison designated under [subsection (g)(1)(J)(ii)](#g-1-J-ii) to assist such personnel and liaison in identifying and meeting the needs of [homeless children and youths](/usc/42/11434a.md?p=2), and provide [training](/usc/42/285e–2.md?p=b-2) on the definitions of terms related to homelessness specified in sections [11302](/usc/42/11302.md), [11360](/usc/42/11360.md), and [11434a](/usc/42/11434a.md) of this title to the liaison; and
  - (7) respond to inquiries from [parents](/usc/42/1396a.md?p=k-3) and guardians of [homeless children and youths](/usc/42/11434a.md?p=2), and (in the case of [unaccompanied youths](/usc/42/11434a.md?p=6)) such youths, to ensure that each [child](/usc/42/416.md?p=e) or youth who is the subject of such an inquiry receives the full protections and services provided by this part.
- (g) **State plan—**
  - (1) **In general—** For any [State](/usc/42/11434a.md?p=5) desiring to receive a grant under this part, the [State educational agency](/usc/42/11434a.md?p=3) shall submit to the [Secretary](/usc/42/11434a.md?p=4) a plan to provide for the education of [homeless children and youths](/usc/42/11434a.md?p=2) within the [State](/usc/42/11434a.md?p=5). Such plan shall include the following:
    - (A) A description of how such [children](/usc/42/256e.md?p=g-2) and youths are (or will be) given the opportunity to meet the same challenging [State](/usc/42/11434a.md?p=5) academic [standards](/usc/42/1320d.md?p=7) as all students are expected to meet.
    - (B) A description of the procedures the [State educational agency](/usc/42/11434a.md?p=3) will use to identify such [children](/usc/42/256e.md?p=g-2) and youths in the [State](/usc/42/11434a.md?p=5) and to assess their needs.
    - (C) A description of procedures for the prompt resolution of disputes regarding the educational placement of [homeless children and youths](/usc/42/11434a.md?p=2).
    - (D) A description of [programs](/usc/42/274l–1.md?p=4) for [school](/usc/42/6372.md?p=1) personnel (including liaisons designated under [subparagraph (J)(ii)](#g-1-J-ii), principals and other [school](/usc/42/6372.md?p=1) leaders, attendance officers, teachers, [enrollment](/usc/42/11434a.md?p=1) personnel, and specialized instructional support personnel) to heighten the awareness of such [school](/usc/42/6372.md?p=1) personnel of the specific needs of [homeless children and youths](/usc/42/11434a.md?p=2), including such [children](/usc/42/256e.md?p=g-2) and youths who are runaway and [homeless youths](/usc/42/290bb–7a.md?p=c-2-D).
    - (E) A description of procedures that ensure that [homeless children and youths](/usc/42/11434a.md?p=2) who meet the relevant eligibility criteria are able to participate in Federal, [State](/usc/42/11434a.md?p=5), or local nutrition [programs](/usc/42/274l–1.md?p=4).
    - (F) A description of procedures that ensure that—
      - (i) [homeless children](/usc/42/9832.md?p=11) have access to public preschool [programs](/usc/42/274l–1.md?p=4), administered by the [State educational agency](/usc/42/11434a.md?p=3) or [local educational agency](/usc/42/11434a.md?p=3), as provided to other [children](/usc/42/256e.md?p=g-2) in the [State](/usc/42/11434a.md?p=5);
      - (ii) youths described in [section 11434a(2) of this title](/usc/42/11434a.md?p=2) and youths separated from public [schools](/usc/42/6372.md?p=1) are identified and accorded equal access to appropriate secondary education and support services, including by identifying and removing barriers that prevent youths described in this clause from receiving appropriate credit for full or partial coursework satisfactorily completed while attending a prior [school](/usc/42/6372.md?p=1), in accordance with [State](/usc/42/11434a.md?p=5), local, and [school](/usc/42/6372.md?p=1) policies; and
      - (iii) [homeless children and youths](/usc/42/11434a.md?p=2) who meet the relevant eligibility criteria do not face barriers to accessing academic and extracurricular activities, including magnet [school](/usc/42/6372.md?p=1), summer [school](/usc/42/6372.md?p=1), career and technical education, advanced placement, online learning, and charter [school](/usc/42/6372.md?p=1) [programs](/usc/42/274l–1.md?p=4), if such [programs](/usc/42/274l–1.md?p=4) are available at the [State](/usc/42/11434a.md?p=5) and local levels.
    - (G) Strategies to address problems identified in the report provided to the [Secretary](/usc/42/11434a.md?p=4) under [subsection (f)(3)](#f-3).
    - (H) Strategies to address other problems with respect to the education of [homeless children and youths](/usc/42/11434a.md?p=2), including problems resulting from [enrollment](/usc/42/11434a.md?p=1) delays that are caused by—
      - (i) requirements of immunization and other required health records;
      - (ii) residency requirements;
      - (iii) lack of birth certificates, [school](/usc/42/6372.md?p=1) records, or other documentation;
      - (iv) guardianship issues; or
      - (v) uniform or dress code requirements.
    - (I) A demonstration that the [State educational agency](/usc/42/11434a.md?p=3) and [local educational agencies](/usc/42/11434a.md?p=3) in the [State](/usc/42/11434a.md?p=5) have developed, and shall review and revise, policies to [remove](/usc/42/9601.md?p=23) barriers to the identification of [homeless children and youths](/usc/42/11434a.md?p=2), and the [enrollment](/usc/42/11434a.md?p=1) and retention of [homeless children and youths](/usc/42/11434a.md?p=2) in [schools](/usc/42/6372.md?p=1) in the [State](/usc/42/11434a.md?p=5), including barriers to [enrollment](/usc/42/11434a.md?p=1) and retention due to outstanding fees or fines, or absences.
    - (J) Assurances that the following will be carried out:
      - (i) The [State educational agency](/usc/42/11434a.md?p=3) and [local educational agencies](/usc/42/11434a.md?p=3) in the [State](/usc/42/11434a.md?p=5) will adopt policies and [practices](/usc/42/17061.md?p=19) to ensure that [homeless children and youths](/usc/42/11434a.md?p=2) are not stigmatized or segregated on the basis of their status as [homeless](/usc/42/11302.md?p=a).
      - (ii) The [local educational agencies](/usc/42/11434a.md?p=3) will designate an appropriate staff [person](/usc/42/1320a–7k.md?p=d-4-C-i), able to carry out the duties described in [paragraph (6)(A)](#g-6-A), who may also be a coordinator for other Federal [programs](/usc/42/274l–1.md?p=4), as a [local educational agency](/usc/42/11434a.md?p=3) liaison for [homeless children and youths](/usc/42/11434a.md?p=2).
      - (iii) The [State](/usc/42/11434a.md?p=5) and the [local educational agencies](/usc/42/11434a.md?p=3) in the [State](/usc/42/11434a.md?p=5) will adopt policies and [practices](/usc/42/17061.md?p=19) to ensure that transportation is provided, at the request of the [parent](/usc/42/1396a.md?p=k-3) or guardian (or in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6), the liaison), to and from the school of origin (as determined under [paragraph (3)](#g-3)), in accordance with the following, as applicable:
        - (I) If the [child](/usc/42/416.md?p=e) or youth continues to live in the area served by the [local educational agency](/usc/42/11434a.md?p=3) in which the school of origin is located, the [child](/usc/42/416.md?p=e)’s or youth’s transportation to and from the school of origin shall be provided or arranged by the [local educational agency](/usc/42/11434a.md?p=3) in which the school of origin is located.
        - (II) If the [child](/usc/42/416.md?p=e)’s or youth’s living arrangements in the area served by the [local educational agency](/usc/42/11434a.md?p=3) of origin terminate and the [child](/usc/42/416.md?p=e) or youth, though continuing the [child](/usc/42/416.md?p=e)’s or youth’s education in the school of origin, begins living in an area served by another [local educational agency](/usc/42/11434a.md?p=3), the [local educational agency](/usc/42/11434a.md?p=3) of origin and the [local educational agency](/usc/42/11434a.md?p=3) in which the [child](/usc/42/416.md?p=e) or youth is living shall agree upon a method to apportion the responsibility and costs for providing the [child](/usc/42/416.md?p=e) or youth with transportation to and from the school of origin. If the [local educational agencies](/usc/42/11434a.md?p=3) are unable to agree upon such method, the responsibility and costs for transportation shall be shared equally.
      - (iv) The [State](/usc/42/11434a.md?p=5) and the [local educational agencies](/usc/42/11434a.md?p=3) in the [State](/usc/42/11434a.md?p=5) will adopt policies and [practices](/usc/42/17061.md?p=19) to ensure participation by liaisons described in [clause (ii)](#g-1-J-ii) in professional development and other technical assistance activities provided pursuant to paragraphs [(5)](#f-5) and [(6)](#f-6) of subsection (f), as determined appropriate by the [Office](/usc/42/3058f.md?p=1) of the Coordinator.
    - (K) A description of how youths described in [section 11434a(2) of this title](/usc/42/11434a.md?p=2) will receive assistance from counselors to advise such youths, and prepare and improve the readiness of such youths for college.
  - (2) **Compliance—**
    - (A) **In general—** Each plan adopted under this subsection shall also describe how the [State](/usc/42/11434a.md?p=5) will ensure that [local educational agencies](/usc/42/11434a.md?p=3) in the [State](/usc/42/11434a.md?p=5) will comply with the requirements of [paragraphs (3) through (7)](#g-3..g-7).
    - (B) **Coordination—** Such plan shall indicate what technical assistance the [State](/usc/42/11434a.md?p=5) will furnish to [local educational agencies](/usc/42/11434a.md?p=3) and how compliance efforts will be coordinated with the [local educational agency](/usc/42/11434a.md?p=3) liaisons designated under [paragraph (1)(J)(ii)](#g-1-J-ii).
  - (3) **Local educational agency requirements—**
    - (A) **In general—** The [local educational agency](/usc/42/11434a.md?p=3) serving each [child](/usc/42/416.md?p=e) or youth to be assisted under this part shall, according to the [child](/usc/42/416.md?p=e)’s or youth’s best interest—
      - (i) continue the [child](/usc/42/416.md?p=e)’s or youth’s education in the [school of origin](#g-3-I-i) for the duration of homelessness—
        - (I) in any case in which a [family](/usc/42/290ff–4.md?p=d-2) becomes [homeless](/usc/42/11302.md?p=a) between academic years or during an academic year; and
        - (II) for the remainder of the academic year, if the [child](/usc/42/416.md?p=e) or youth becomes permanently housed during an academic year; or
      - (ii) [enroll](/usc/42/11434a.md?p=1) the [child](/usc/42/416.md?p=e) or youth in any public [school](/usc/42/6372.md?p=1) that nonhomeless students who live in the attendance area in which the [child](/usc/42/416.md?p=e) or youth is actually living are eligible to attend.
    - (B) **School stability—** In determining the best interest of the [child](/usc/42/416.md?p=e) or youth under [subparagraph (A)](#g-3-A), the [local educational agency](/usc/42/11434a.md?p=3) shall—
      - (i) presume that keeping the [child](/usc/42/416.md?p=e) or youth in the [school of origin](#g-3-I-i) is in the [child](/usc/42/416.md?p=e)’s or youth’s best interest, except when doing so is contrary to the request of the [child](/usc/42/416.md?p=e)’s or youth’s [parent](/usc/42/1396a.md?p=k-3) or guardian, or (in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6)) the youth;
      - (ii) consider student-centered factors related to the [child](/usc/42/416.md?p=e)’s or youth’s best interest, including factors related to the impact of mobility on achievement, education, health, and safety of [homeless children](/usc/42/9832.md?p=11) and youth, giving priority to the request of the [child](/usc/42/416.md?p=e)’s or youth’s [parent](/usc/42/1396a.md?p=k-3) or guardian or (in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6)) the youth;
      - (iii) if, after conducting the best interest determination based on consideration of the presumption in [clause (i)](#g-3-B-i) and the student-centered factors in [clause (ii)](#g-3-B-ii), the [local educational agency](/usc/42/11434a.md?p=3) determines that it is not in the [child](/usc/42/416.md?p=e)’s or youth’s best interest to attend the [school of origin](#g-3-I-i) or the [school](/usc/42/6372.md?p=1) requested by the [parent](/usc/42/1396a.md?p=k-3) or guardian, or (in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6)) the youth, provide the [child](/usc/42/416.md?p=e)’s or youth’s [parent](/usc/42/1396a.md?p=k-3) or guardian or the [unaccompanied youth](/usc/42/11434a.md?p=6) with a written explanation of the reasons for its determination, in a manner and form understandable to such [parent](/usc/42/1396a.md?p=k-3), guardian, or [unaccompanied youth](/usc/42/11434a.md?p=6), including information regarding the right to appeal under [subparagraph (E)](#g-3-E); and
      - (iv) in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6), ensure that the [local educational agency](/usc/42/11434a.md?p=3) liaison designated under [paragraph (1)(J)(ii)](#g-1-J-ii) assists in placement or [enrollment](/usc/42/11434a.md?p=1) decisions under this subparagraph, gives priority to the views of such [unaccompanied youth](/usc/42/11434a.md?p=6), and provides notice to such youth of the right to appeal under [subparagraph (E)](#g-3-E).
    - (C) **Immediate enrollment—**
      - (i) **In general—** The [school](/usc/42/6372.md?p=1) selected in accordance with this paragraph shall immediately [enroll](/usc/42/11434a.md?p=1) the [homeless](/usc/42/11302.md?p=a) [child](/usc/42/416.md?p=e) or youth, even if the [child](/usc/42/416.md?p=e) or youth—
        - (I) is unable to produce records normally required for [enrollment](/usc/42/11434a.md?p=1), such as previous academic records, records of immunization and other required health records, proof of residency, or other documentation; or
        - (II) has missed application or [enrollment](/usc/42/11434a.md?p=1) deadlines during any period of homelessness.
      - (ii) **Relevant academic records—** The enrolling [school](/usc/42/6372.md?p=1) shall immediately contact the [school](/usc/42/6372.md?p=1) last attended by the [child](/usc/42/416.md?p=e) or youth to obtain relevant academic and other records.
      - (iii) **Relevant health records—** If the [child](/usc/42/416.md?p=e) or youth needs to obtain immunizations or other required health records, the enrolling [school](/usc/42/6372.md?p=1) shall immediately refer the [parent](/usc/42/1396a.md?p=k-3) or guardian of the [child](/usc/42/416.md?p=e) or youth, or (in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6)) the youth, to the [local educational agency](/usc/42/11434a.md?p=3) liaison designated under [paragraph (1)(J)(ii)](#g-1-J-ii), who shall assist in obtaining necessary immunizations or screenings, or immunization or other required health records, in accordance with [subparagraph (D)](#g-3-D).
    - (D) **Records—** Any record ordinarily kept by the [school](/usc/42/6372.md?p=1), including immunization or other required health records, academic records, birth certificates, guardianship records, and evaluations for special services or [programs](/usc/42/274l–1.md?p=4), regarding each [homeless](/usc/42/11302.md?p=a) [child](/usc/42/416.md?p=e) or youth shall be maintained—
      - (i) so that the records involved are available, in a timely fashion, when a [child](/usc/42/416.md?p=e) or youth enters a new [school](/usc/42/6372.md?p=1) or [school](/usc/42/6372.md?p=1) district; and
      - (ii) in a manner consistent with [section 1232g of title 20](/usc/20/1232g.md).
    - (E) **Enrollment disputes—** If a dispute arises over eligibility, or [school](/usc/42/6372.md?p=1) selection or [enrollment](/usc/42/11434a.md?p=1) in a [school](/usc/42/6372.md?p=1)—
      - (i) the [child](/usc/42/416.md?p=e) or youth shall be immediately enrolled in the [school](/usc/42/6372.md?p=1) in which [enrollment](/usc/42/11434a.md?p=1) is sought, pending final resolution of the dispute, including all available appeals;
      - (ii) the [parent](/usc/42/1396a.md?p=k-3) or guardian of the [child](/usc/42/416.md?p=e) or youth or (in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6)) the youth shall be provided with a written explanation of any decisions related to [school](/usc/42/6372.md?p=1) selection or [enrollment](/usc/42/11434a.md?p=1) made by the [school](/usc/42/6372.md?p=1), the [local educational agency](/usc/42/11434a.md?p=3), or the [State educational agency](/usc/42/11434a.md?p=3) involved, including the rights of the [parent](/usc/42/1396a.md?p=k-3), guardian, or [unaccompanied youth](/usc/42/11434a.md?p=6) to appeal such decisions;
      - (iii) the [parent](/usc/42/1396a.md?p=k-3), guardian, or [unaccompanied youth](/usc/42/11434a.md?p=6) shall be referred to the [local educational agency](/usc/42/11434a.md?p=3) liaison designated under [paragraph (1)(J)(ii)](#g-1-J-ii), who shall carry out the dispute resolution process as described in [paragraph (1)(C)](#g-1-C) as expeditiously as possible after receiving notice of the dispute; and
      - (iv) in the case of an [unaccompanied youth](/usc/42/11434a.md?p=6), the liaison shall ensure that the youth is immediately enrolled in the [school](/usc/42/6372.md?p=1) in which the youth seeks [enrollment](/usc/42/11434a.md?p=1) pending resolution of such dispute.
    - (F) **Placement choice—** The choice regarding placement shall be made regardless of whether the [child](/usc/42/416.md?p=e) or youth lives with the [homeless](/usc/42/11302.md?p=a) [parents](/usc/42/1396a.md?p=k-3) or has been temporarily placed elsewhere.
    - (G) **Privacy—** Information about a [homeless](/usc/42/11302.md?p=a) [child](/usc/42/416.md?p=e)’s or youth’s living situation shall be treated as a student education record, and shall not be deemed to be directory information, under [section 1232g of title 20](/usc/20/1232g.md).
    - (H) **Contact information—** Nothing in this part shall prohibit a [local educational agency](/usc/42/11434a.md?p=3) from requiring a [parent](/usc/42/1396a.md?p=k-3) or guardian of a [homeless](/usc/42/11302.md?p=a) [child](/usc/42/416.md?p=e) or youth to submit contact information.
    - (I) **School of origin defined—** In this paragraph:
      - (i) **In general—** The term “school of origin” means the [school](/usc/42/6372.md?p=1) that a [child](/usc/42/416.md?p=e) or youth attended when permanently housed or the [school](/usc/42/6372.md?p=1) in which the [child](/usc/42/416.md?p=e) or youth was last enrolled, including a preschool.
      - (ii) **Receiving school—** When the [child](/usc/42/416.md?p=e) or youth completes the final grade level served by the [school of origin](#g-3-I-i), as described in [clause (i)](#g-3-I-i), the term “[school of origin](#g-3-I-i)” shall include the designated receiving [school](/usc/42/6372.md?p=1) at the next grade level for all feeder [schools](/usc/42/6372.md?p=1).
  - (4) **Comparable services—** Each [homeless](/usc/42/11302.md?p=a) [child](/usc/42/416.md?p=e) or youth to be assisted under this part shall be provided services comparable to services offered to other students in the [school](/usc/42/6372.md?p=1) selected under [paragraph (3)](#g-3), including the following:
    - (A) Transportation services.
    - (B) Educational services for which the [child](/usc/42/416.md?p=e) or youth meets the eligibility criteria, such as services provided under title I of the Elementary and Secondary Education Act of 1965 ([20 U.S.C. 6301](/usc/20/6301.md) et seq.) or similar [State](/usc/42/11434a.md?p=5) or local [programs](/usc/42/274l–1.md?p=4), educational [programs](/usc/42/274l–1.md?p=4) for [children](/usc/42/256e.md?p=g-2) with disabilities, and educational [programs](/usc/42/274l–1.md?p=4) for [English learners](/usc/42/9858n.md?p=5).
    - (C) [Programs](/usc/42/274l–1.md?p=4) in career and technical education.
    - (D) [Programs](/usc/42/274l–1.md?p=4) for gifted and talented students.
    - (E) [School](/usc/42/6372.md?p=1) nutrition [programs](/usc/42/274l–1.md?p=4).
  - (5) **Coordination—**
    - (A) **In general—** Each [local educational agency](/usc/42/11434a.md?p=3) serving [homeless children and youths](/usc/42/11434a.md?p=2) that receives assistance under this part shall coordinate—
      - (i) the provision of services under this part with local social services agencies and other agencies or entities providing services to [homeless children and youths](/usc/42/11434a.md?p=2) and their [families](/usc/42/12704.md?p=11), including services and [programs](/usc/42/274l–1.md?p=4) funded under the Runaway and Homeless Youth Act ([42 U.S.C. 5701](/usc/42/5701.md) et seq.);[^1] and
      - (ii) transportation, transfer of [school](/usc/42/6372.md?p=1) records, and other interdistrict activities, with other [local educational agencies](/usc/42/11434a.md?p=3).
    - (B) **Housing assistance—** If applicable, each [State educational agency](/usc/42/11434a.md?p=3) and [local educational agency](/usc/42/11434a.md?p=3) that receives assistance under this part shall coordinate with [State](/usc/42/11434a.md?p=5) and local [housing](/usc/42/1490p–2.md?p=r-3) agencies responsible for developing the comprehensive [housing](/usc/42/1490p–2.md?p=r-3) affordability strategy described in [section 12705 of this title](/usc/42/12705.md) to minimize educational disruption for [children](/usc/42/256e.md?p=g-2) and youths who become [homeless](/usc/42/11302.md?p=a).
    - (C) **Coordination purpose—** The coordination required under subparagraphs [(A)](#g-5-A) and [(B)](#g-5-B) shall be designed to—
      - (i) ensure that all [homeless children and youths](/usc/42/11434a.md?p=2) are promptly identified;
      - (ii) ensure that all [homeless children and youths](/usc/42/11434a.md?p=2) have access to, and are in reasonable proximity to, available education and related support services; and
      - (iii) raise the awareness of [school](/usc/42/6372.md?p=1) personnel and service providers of the effects of short-term stays in a shelter and other challenges associated with homelessness.
    - (D) **Homeless children and youths with disabilities—** For [children](/usc/42/256e.md?p=g-2) and youths who are to be assisted both under this part, and under the Individuals with Disabilities Education Act ([20 U.S.C. 1400](/usc/20/1400.md) et seq.) or [section 794 of title 29](/usc/29/794.md), each [local educational agency](/usc/42/11434a.md?p=3) shall coordinate the provision of services under this part with the provision of [programs](/usc/42/274l–1.md?p=4) for [children](/usc/42/256e.md?p=g-2) with disabilities served by that [local educational agency](/usc/42/11434a.md?p=3) and other involved [local educational agencies](/usc/42/11434a.md?p=3).
  - (6) **Local educational agency liaison—**
    - (A) **Duties—** Each [local educational agency](/usc/42/11434a.md?p=3) liaison for [homeless children and youths](/usc/42/11434a.md?p=2), designated under [paragraph (1)(J)(ii)](#g-1-J-ii), shall ensure that—
      - (i) [homeless children and youths](/usc/42/11434a.md?p=2) are identified by [school](/usc/42/6372.md?p=1) personnel through outreach and coordination activities with other entities and agencies;
      - (ii) [homeless children and youths](/usc/42/11434a.md?p=2) are enrolled in, and have a full and equal opportunity to succeed in, [schools](/usc/42/6372.md?p=1) of that [local educational agency](/usc/42/11434a.md?p=3);
      - (iii) [homeless](/usc/42/11302.md?p=a) [families](/usc/42/12704.md?p=11) and [homeless children and youths](/usc/42/11434a.md?p=2) have access to and receive educational services for which such [families](/usc/42/12704.md?p=11), [children](/usc/42/256e.md?p=g-2), and youths are eligible, including services through Head Start [programs](/usc/42/274l–1.md?p=4) (including Early Head Start [programs](/usc/42/274l–1.md?p=4)) under the Head Start Act ([42 U.S.C. 9831](/usc/42/9831.md) et seq.), early intervention services under part C of the Individuals with Disabilities Education Act ([20 U.S.C. 1431](/usc/20/1431.md) et seq.), and other preschool [programs](/usc/42/274l–1.md?p=4) administered by the [local educational agency](/usc/42/11434a.md?p=3);
      - (iv) [homeless](/usc/42/11302.md?p=a) [families](/usc/42/12704.md?p=11) and [homeless children and youths](/usc/42/11434a.md?p=2) receive referrals to health care services, dental services, mental health and [substance abuse services](/usc/42/290cc–34.md?p=4), [housing](/usc/42/1490p–2.md?p=r-3) services, and other appropriate services;
      - (v) the [parents](/usc/42/1396a.md?p=k-3) or guardians of [homeless children and youths](/usc/42/11434a.md?p=2) are informed of the educational and related opportunities available to their [children](/usc/42/256e.md?p=g-2) and are provided with meaningful opportunities to participate in the education of their [children](/usc/42/256e.md?p=g-2);
      - (vi) public notice of the educational rights of [homeless children and youths](/usc/42/11434a.md?p=2) is disseminated in locations frequented by [parents](/usc/42/1396a.md?p=k-3) or guardians of such [children](/usc/42/256e.md?p=g-2) and youths, and [unaccompanied youths](/usc/42/11434a.md?p=6), including [schools](/usc/42/6372.md?p=1), shelters, public libraries, and soup kitchens, in a manner and form understandable to the [parents](/usc/42/1396a.md?p=k-3) and guardians of [homeless children and youths](/usc/42/11434a.md?p=2), and [unaccompanied youths](/usc/42/11434a.md?p=6);
      - (vii) [enrollment](/usc/42/11434a.md?p=1) disputes are mediated in accordance with [paragraph (3)(E)](#g-3-E);
      - (viii) the [parent](/usc/42/1396a.md?p=k-3) or guardian of a [homeless](/usc/42/11302.md?p=a) [child](/usc/42/416.md?p=e) or youth, and any [unaccompanied youth](/usc/42/11434a.md?p=6), is fully informed of all transportation services, including transportation to the school of origin, as described in [paragraph (1)(J)(iii)](#g-1-J-iii), and is assisted in accessing transportation to the [school](/usc/42/6372.md?p=1) that is selected under [paragraph (3)(A)](#g-3-A);
      - (ix) [school](/usc/42/6372.md?p=1) personnel providing services under this part receive professional development and other support; and
      - (x) [unaccompanied youths](/usc/42/11434a.md?p=6)—
        - (I) are enrolled in [school](/usc/42/6372.md?p=1);
        - (II) have opportunities to meet the same challenging [State](/usc/42/11434a.md?p=5) academic [standards](/usc/42/1320d.md?p=7) as the [State](/usc/42/11434a.md?p=5) establishes for other [children](/usc/42/256e.md?p=g-2) and youth, including through implementation of the procedures under [paragraph (1)(F)(ii)](#g-1-F-ii); and
        - (III) are informed of their status as independent students under [section 1087vv of title 20](/usc/20/1087vv.md) and that the youths may obtain assistance from the [local educational agency](/usc/42/11434a.md?p=3) liaison to receive verification of such status for purposes of the Free Application for Federal Student Aid described in [section 1090 of title 20](/usc/20/1090.md).
    - (B) **Notice—** [State](/usc/42/11434a.md?p=5) Coordinators established under [subsection (d)(3)](#d-3) and [local educational agencies](/usc/42/11434a.md?p=3) shall inform [school](/usc/42/6372.md?p=1) personnel, service providers, advocates working with [homeless](/usc/42/11302.md?p=a) [families](/usc/42/12704.md?p=11), [parents](/usc/42/1396a.md?p=k-3) and guardians of [homeless children and youths](/usc/42/11434a.md?p=2), and [homeless children and youths](/usc/42/11434a.md?p=2) of the duties of the [local educational agency](/usc/42/11434a.md?p=3) liaisons, and publish an annually updated list of the liaisons on the [State educational agency](/usc/42/11434a.md?p=3)’s website.
    - (C) **Local and State coordination—** [Local educational agency](/usc/42/11434a.md?p=3) liaisons for [homeless children and youths](/usc/42/11434a.md?p=2) shall, as a part of their duties, coordinate and collaborate with [State](/usc/42/11434a.md?p=5) Coordinators and community and [school](/usc/42/6372.md?p=1) personnel responsible for the provision of education and related services to [homeless children and youths](/usc/42/11434a.md?p=2). Such coordination shall include collecting and providing to the [State](/usc/42/11434a.md?p=5) Coordinator the reliable, valid, and comprehensive data needed to meet the requirements of paragraphs [(1)](#f-1) and [(3)](#f-3) of subsection (f).
    - (D) **Homeless status—** A [local educational agency](/usc/42/11434a.md?p=3) liaison designated under [paragraph (1)(J)(ii)](#g-1-J-ii) who receives [training](/usc/42/285e–2.md?p=b-2) described in [subsection (f)(6)](#f-6) may affirm, without further agency action by the Department of [Housing](/usc/42/1490p–2.md?p=r-3) and Urban Development, that a [child](/usc/42/416.md?p=e) or youth who is eligible for and participating in a [program](/usc/42/274l–1.md?p=4) provided by the [local educational agency](/usc/42/11434a.md?p=3), or the immediate [family](/usc/42/290ff–4.md?p=d-2) of such a [child](/usc/42/416.md?p=e) or youth, who meets the eligibility requirements of this chapter for a [program](/usc/42/274l–1.md?p=4) or service authorized under subchapter IV, is eligible for such [program](/usc/42/274l–1.md?p=4) or service.
  - (7) **Review and revisions—**
    - (A) **In general—** Each [State educational agency](/usc/42/11434a.md?p=3) and [local educational agency](/usc/42/11434a.md?p=3) that receives assistance under this part shall review and revise any policies that may act as barriers to the identification of [homeless children and youths](/usc/42/11434a.md?p=2) or the [enrollment](/usc/42/11434a.md?p=1) of [homeless children and youths](/usc/42/11434a.md?p=2) in [schools](/usc/42/6372.md?p=1) that are selected under [paragraph (3)](#g-3).
    - (B) **Consideration—** In reviewing and revising such policies, consideration shall be given to issues concerning transportation, immunization, residency, birth certificates, [school](/usc/42/6372.md?p=1) records and other documentation, and guardianship.
    - (C) **Special attention—** Special attention shall be given to ensuring the identification, [enrollment](/usc/42/11434a.md?p=1), and attendance of [homeless children and youths](/usc/42/11434a.md?p=2) who are not currently attending [school](/usc/42/6372.md?p=1).
