# §3109. Indian forest land assistance account

- (a) **Establishment—** At the request of an [Indian tribe](/usc/25/81.md?p=a-2), the [Secretary](/usc/25/3103.md?p=13) may establish a special [Indian forest land](/usc/25/3103.md?p=3) assistance account within the [tribe](/usc/25/3402.md?p=2-A)’s trust fund account to fund the [Indian forest land](/usc/25/3103.md?p=3) management activities of such [tribe](/usc/25/3402.md?p=2-A).
- (b) **Deposits and expenditures—**
  - (1) The [Secretary](/usc/25/3103.md?p=13) may deposit into the [Indian forest land](/usc/25/3103.md?p=3) assistance account established pursuant to [subsection (a)](#a) any funds received by the [Secretary](/usc/25/3103.md?p=13) or in the [Secretary](/usc/25/3103.md?p=13)’s possession from—
    - (A) non-Federal sources, if such funds are related to activities on or for the [Indian forest lands](/usc/25/3103.md?p=3) of such [tribe](/usc/25/3402.md?p=2-A)’s [reservation](/usc/25/3103.md?p=12),
    - (B) donations and contributions,
    - (C) unobligated forestry appropriations for the benefit of such [Indian tribe](/usc/25/81.md?p=a-2), and
    - (D) user fees or other funds transferred under Federal interagency agreements if otherwise authorized by Federal law and, if such funds are related to activities on or for the [Indian forest lands](/usc/25/3103.md?p=3) of such [tribe](/usc/25/3402.md?p=2-A)’s [reservation](/usc/25/3103.md?p=12).

    Funds deposited in such account shall be for the purpose of conducting [forest land management activities](/usc/25/3103.md?p=4) on the [Indian forest lands](/usc/25/3103.md?p=3) of such [tribe](/usc/25/3402.md?p=2-A).

  - (2) Funds in the [Indian forest land](/usc/25/3103.md?p=3) assistance account and any interest or other income earned thereon shall remain available until expended and shall not be available to otherwise offset Federal appropriations for meeting the Federal responsibility for management of [Indian forest lands](/usc/25/3103.md?p=3).
- (c) **Audits—** At the request of an [Indian tribe](/usc/25/81.md?p=a-2) or upon the [Secretary](/usc/25/3103.md?p=13)’s own volition, the [Secretary](/usc/25/3103.md?p=13) may conduct audits of the [Indian forest land](/usc/25/3103.md?p=3) assistance account and shall publish the results of such audit.
