# §3643. Transfer of Federal employees

- (a) **Authority to enter into agreements; reemployment rights—** The head of any [agency](#b) may enter into [agreements](/usc/22/2431a.md?p=7) for the transfer or detail to the [Commission](/usc/22/277d–43.md?p=2) of any [employee](/usc/22/4341.md?p=1) of that [agency](#b) serving under a permanent appointment. Any [employee](/usc/22/4341.md?p=1) who so transfers or is so detailed shall, upon completion of the [employee](/usc/22/4341.md?p=1)’s tour of duty with the [Commission](/usc/22/277d–43.md?p=2), be entitled to reemployment with the [agency](#b) from which the [employee](/usc/22/4341.md?p=1) was transferred or detailed without loss of pay, seniority, or other rights or benefits to which the [employee](/usc/22/4341.md?p=1) would have been entitled had the [employee](/usc/22/4341.md?p=1) not been so transferred or been so detailed.
- (b) **“Agency” defined—** For purposes of this section, the term “agency” means an [Executive agency](/usc/22/3641.md?p=1), the [United States](/usc/22/1395.md?p=a-1) Postal Service, and the Smithsonian Institution.
- (c) **Regulations—** The [Office](/usc/22/2214a.md?p=9) of Personnel Management shall prescribe regulations to carry out the purposes of this section.
