# §62. Manufacture, shipment, or delivery for shipment in interstate or foreign commerce prohibited


It is declared that [filled milk](/usc/21/61.md?p=c), as defined in [section 61 of this title](/usc/21/61.md), is an adulterated article of [food](/usc/21/346a.md?p=a-1), injurious to the public health, and its sale constitutes a fraud upon the public. It shall be unlawful for any [person](/usc/21/61.md?p=a) to manufacture within any [Territory](/usc/21/387.md?p=19) or possession, or within the District of Columbia, or to ship or deliver for shipment in [interstate or foreign commerce](/usc/21/61.md?p=b), any [filled milk](/usc/21/61.md?p=c).
