# §10001. Allocations

- (a) **Outlying areas—** From the amount appropriated to carry out this chapter, the [Secretary](/usc/20/10013.md?p=4) of Education shall first allocate up to one-half of 1 percent to the [outlying areas](/usc/20/9501.md?p=1-B) on the basis of their respective needs, as determined by the [Secretary](/usc/20/10013.md?p=4), in consultation with the [Secretary](/usc/20/10013.md?p=4) of the Interior, for activities consistent with this chapter under such terms and conditions as the [Secretary](/usc/20/10013.md?p=4) may determine.
- (b) **Administration and oversight—** The [Secretary](/usc/20/10013.md?p=4) may, in addition, reserve up to $14,000,000 for administration and oversight of this chapter, including for program evaluation.
- (c) **Reservation for additional programs—** After reserving [funds](/usc/20/4702.md?p=3) under subsections [(a)](#a) and [(b)](#b), the [Secretary](/usc/20/10013.md?p=4) shall reserve $5,000,000,000 for grants under sections [10006](/usc/20/10006.md) and [10007](/usc/20/10007.md) of this title.
- (d) **State allocations—** After carrying out subsections [(a)](#a), [(b)](#b), and [(c)](#c), the [Secretary](/usc/20/10013.md?p=4) shall allocate the remaining [funds](/usc/20/4702.md?p=3) made available to carry out this chapter to the [States](/usc/20/10013.md?p=5) as follows:
  - (1) 61 percent on the basis of their relative population of individuals aged 5 through 24.
  - (2) 39 percent on the basis of their relative total population.
- (e) **State grants—** From [funds](/usc/20/4702.md?p=3) allocated under [subsection (d)](#d), the [Secretary](/usc/20/10013.md?p=4) shall make grants to the Governor of each [State](/usc/20/10013.md?p=5).
- (f) **Reallocation—** The Governor shall return to the [Secretary](/usc/20/10013.md?p=4) any [funds](/usc/20/4702.md?p=3) received under [subsection (e)](#e) that the Governor does not award as subgrants or otherwise commit within two years of receiving such [funds](/usc/20/4702.md?p=3), and the [Secretary](/usc/20/10013.md?p=4) shall reallocate such [funds](/usc/20/4702.md?p=3) to the remaining [States](/usc/20/10013.md?p=5) in accordance with [subsection (d)](#d).
