# §8202. Definitions


In this chapter:

- (1) **Appropriate congressional committees—** The term “appropriate congressional committees” means—
  - (A) the [Committee](/usc/16/941b.md?p=1) on Commerce, Science, and Transportation and the [Committee](/usc/16/941b.md?p=1) on Environment and Public Works of the Senate; and
  - (B) the [Committee](/usc/16/941b.md?p=1) on Natural [Resources](/usc/16/410hhh–1.md?p=8) of the House of [Representatives](/usc/16/5609.md?p=13).
- (2) **Board—** The term “[Board](/usc/16/1447a.md?p=1)” means the National Fish Habitat [Board](/usc/16/1447a.md?p=1) established by [section 8203 of this title](/usc/16/8203.md).
- (3) **Director—** The term “Director” means the Director of the United States Fish and Wildlife Service.
- (4) **Environmental Protection Agency Assistant Administrator—** The term “Environmental Protection Agency Assistant Administrator” means the Assistant [Administrator](/usc/16/450rr–1.md?p=a) for Water of the Environmental Protection Agency.
- (5) **Indian Tribe—** The term “Indian Tribe” has the meaning given to the term “Indian tribe” in [section 5304 of title 25](/usc/25/5304.md).
- (6) **National Oceanic and Atmospheric Administration Assistant Administrator—** The term “National Oceanic and Atmospheric Administration Assistant Administrator” means the Assistant [Administrator](/usc/16/450rr–1.md?p=a) for [Fisheries](/usc/16/1383a.md?p=o-1) of the National Oceanic and Atmospheric Administration.
- (7) **Partnership—** The term “Partnership” means an entity designated by Congress as a Fish Habitat Partnership under [section 8204 of this title](/usc/16/8204.md).
- (8) **Real property interest—** The term “real property interest” means an ownership interest in—
  - (A) land; or
  - (B) water (including water rights).
- (9) **Marine Fisheries Commissions—** The term “Marine Fisheries Commissions” means—
  - (A) the Atlantic [States](/usc/16/544.md?p=r) Marine [Fisheries](/usc/16/1383a.md?p=o-1) [Commission](/usc/16/410cc–1.md?p=3);
  - (B) the Gulf [States](/usc/16/544.md?p=r) Marine [Fisheries](/usc/16/1383a.md?p=o-1) [Commission](/usc/16/410cc–1.md?p=3); and
  - (C) the Pacific [States](/usc/16/544.md?p=r) Marine [Commission](/usc/16/410cc–1.md?p=3).
- (10) **Secretary—** The term “Secretary” means the Secretary of the Interior.
- (11) **State—** The term “State” means each of the several [States](/usc/16/544.md?p=r), Puerto Rico, American Samoa, Guam, the Northern Mariana Islands, the United States Virgin Islands, and the District of Columbia.
- (12) **State agency—** The term “State agency” means—
  - (A) the fish and wildlife agency of a [State](#11); and
  - (B) any department or division of a department or agency of a [State](#11) that manages in the public [trust](/usc/16/450ss–1.md?p=4) the inland or marine [fishery](/usc/16/1383a.md?p=o-1) [resources](/usc/16/410hhh–1.md?p=8) of the [State](#11) or sustains the habitat for those [fishery](/usc/16/1383a.md?p=o-1) [resources](/usc/16/410hhh–1.md?p=8) pursuant to [State](#11) law or the constitution of the [State](#11).
