# §81p. Property transfers

- (a) **Transfer and rights-of-way—** The [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior (hereinafter in this section referred to as the “[Secretary](/usc/16/410r–5.md?p=c-1)”) is authorized to transfer, without reimbursement, to York County, Virginia, that portion of the existing sewage disposal [system](/usc/16/668ee.md?p=14), including related improvements and structures, owned by the United States and located within the Colonial National [Historical Park](/usc/16/410eee–1.md?p=1), together with such rights-of-way as are determined by the [Secretary](/usc/16/410r–5.md?p=c-1) to be necessary to maintain and operate such [system](/usc/16/668ee.md?p=14).
- (b) **Repair and rehabilitation of system—** The [Secretary](/usc/16/410r–5.md?p=c-1) is authorized to enter into a cooperative agreement with York County, Virginia, under which the [Secretary](/usc/16/410r–5.md?p=c-1) will pay a portion, not to exceed $110,000, of the costs of repair and rehabilitation of the sewage disposal [system](/usc/16/668ee.md?p=14) referred to in [subsection (a)](#a).
- (c) **Fees and charges—** In consideration for the rights-of-way granted under [subsection (a)](#a), and in recognition of the [National Park](/usc/16/410hhh–1.md?p=5) Service’s contribution authorized under [subsection (b)](#b), the cooperative agreement under [subsection (b)](#b) shall provide for a reduction in, or the elimination of, the amounts charged to the [National Park](/usc/16/410hhh–1.md?p=5) Service for its sewage disposal. The cooperative agreement shall also provide for minimizing the impact of the sewage disposal [system](/usc/16/668ee.md?p=14) on the [park](/usc/16/410r–5.md?p=c-3) and its [resources](/usc/16/410hhh–1.md?p=8). Such [system](/usc/16/668ee.md?p=14) may not be enlarged or substantially altered without [National Park](/usc/16/410hhh–1.md?p=5) Service concurrence.
- (d) **Inclusion of land in Colonial National Historical Park—** Notwithstanding the provisions of sections [81b](/usc/16/81b.md) and [81d](/usc/16/81d.md) of this title, limiting the average width of the Colonial Parkway, the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior is authorized to include within the boundaries of Colonial National [Historical Park](/usc/16/410eee–1.md?p=1) and to [acquire](/usc/16/620e.md?p=1) by donation, exchange, or purchase with donated or appropriated [funds](/usc/16/1421h.md?p=2) the lands or interests in lands (with or without improvements) within the [areas](/usc/16/539m–1.md?p=1-A) depicted on the [map](/usc/16/430f–7.md?p=1) dated August 1996, numbered 333/80031B, and entitled “Page Landing [Addition](/usc/16/410r–5.md?p=c-2) to Colonial National [Historical Park](/usc/16/410eee–1.md?p=1)”. Such [map](/usc/16/430f–7.md?p=1) shall be on file and available for inspection in the offices of the [National Park](/usc/16/410hhh–1.md?p=5) Service at Colonial National [Historical Park](/usc/16/410eee–1.md?p=1) and in Washington, District of Columbia.
- (e) **Authorization of appropriations—** There are authorized to be appropriated such sums as are necessary to carry out this section.
