# §698q. Little River Canyon National Preserve; establishment

- (a) **In general—** In order to protect and [preserve](/usc/16/410hhh–1.md?p=7) the natural, scenic, recreational, and cultural [resources](/usc/16/410hhh–1.md?p=8) of the Little River Canyon [area](/usc/16/539m–1.md?p=1-A) in DeKalb and Cherokee [Counties](/usc/16/544.md?p=d), Alabama, and to provide for the protection and public enjoyment of the [resources](/usc/16/410hhh–1.md?p=8), there is established the Little River Canyon National [Preserve](/usc/16/410hhh–1.md?p=7) (referred to in [sections 698q to 698t](/usc/16/698q..698t.md) of this title as the “[Preserve](/usc/16/410hhh–1.md?p=7)”).
- (b) **Area included—**
  - (1) **In general—** The [Preserve](/usc/16/410hhh–1.md?p=7) shall consist of the lands, waters, and interests in lands and waters generally depicted on the boundary [map](/usc/16/430f–7.md?p=1) entitled “Little River Canyon National [Preserve](/usc/16/410hhh–1.md?p=7)”, numbered NA–LRNP–80,001C, and dated March 1992.
  - (2) **Boundary expansion—** The boundary of the [Preserve](/usc/16/410hhh–1.md?p=7) is modified to include the land depicted on the [map](/usc/16/430f–7.md?p=1) entitled “Little River Canyon National [Preserve](/usc/16/410hhh–1.md?p=7) Proposed Boundary”, numbered 152/80,004, and dated December 2007.
- (c) **Map—** The [maps](/usc/16/430f–7.md?p=1) referred to in [subsection (b)](#b) shall—
  - (1) be on file and available for public inspection in the offices of the [National Park](/usc/16/410hhh–1.md?p=5) Service of the Department of the Interior in Washington, District of Columbia; and
  - (2) be filed with the appropriate offices of DeKalb and Cherokee [Counties](/usc/16/544.md?p=d) in the [State](/usc/16/6456.md?p=2) of Alabama.
- (d) **Publication of description—** Not later than 6 months after October 21, 1992, the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior (referred to in [sections 698q to 698t](/usc/16/698q..698t.md) of this title as the “[Secretary](/usc/16/410r–5.md?p=c-1)”) shall publish in the Federal Register a detailed description of the boundaries of the [Preserve](/usc/16/410hhh–1.md?p=7).

# §698r. Administration

- (a) **In general—** The [Preserve](/usc/16/410hhh–1.md?p=7) shall be administered by the [Secretary](/usc/16/410r–5.md?p=c-1) in accordance with [sections 698q to 698t](/usc/16/698q..698t.md) of this title and in accordance with the laws generally applicable to [units](/usc/16/430f–7.md?p=4) of the [National Park](/usc/16/410hhh–1.md?p=5) [System](/usc/16/668ee.md?p=14), including—
  - (1) the Act entitled “An Act to establish a [National Park](/usc/16/410hhh–1.md?p=5) Service, and for other purposes”, approved August 25, 1916 ([16 U.S.C. 1](/usc/16/1.md) et seq.);[^1] and
  - (2) the Act entitled “An Act to provide for the preservation of historic American sites, buildings, objects, and antiquities of national significance, and for other purposes”, approved August 21, 1935 ([16 U.S.C. 461](/usc/16/461.md) et seq.).[^1]
- (b) **Hunting and fishing—**
  - (1) **In general—** Subject to paragraphs [(2)](#b-2) and [(3)](#b-3), the [Secretary](/usc/16/410r–5.md?p=c-1) shall permit hunting, trapping, and [fishing](/usc/16/7901.md?p=b) on lands and waters under the jurisdiction of the [Secretary](/usc/16/410r–5.md?p=c-1) within the [Preserve](/usc/16/410hhh–1.md?p=7) in accordance with applicable Federal and [State](/usc/16/6456.md?p=2) laws.
  - (2) **Time and place restrictions—** Subject to such terms and conditions as the [Secretary](/usc/16/410r–5.md?p=c-1) considers necessary in furtherance of [sections 698q to 698t](/usc/16/698q..698t.md) of this title, and after consultation with the Department of [Conservation](/usc/16/6456.md?p=2) and Natural [Resources](/usc/16/410hhh–1.md?p=8) of the [State](/usc/16/6456.md?p=2) of Alabama and [owners](/usc/16/429b–3.md?p=4) of lands adjacent to the [Preserve](/usc/16/410hhh–1.md?p=7), the [Secretary](/usc/16/410r–5.md?p=c-1) may designate zones where, and establish periods when, the activities described in [paragraph (1)](#b-1) will not be permitted within the [Preserve](/usc/16/410hhh–1.md?p=7) for reasons of public safety, administration, fish and wildlife habitat, or public use and enjoyment.
  - (3) **Restrictions in boundary areas—** After consultation with the Department of [Conservation](/usc/16/6456.md?p=2) and Natural [Resources](/usc/16/410hhh–1.md?p=8) of the [State](/usc/16/6456.md?p=2) of Alabama and with the [owners](/usc/16/429b–3.md?p=4) of lands adjacent to the [Preserve](/usc/16/410hhh–1.md?p=7), the [Secretary](/usc/16/410r–5.md?p=c-1) may restrict hunting in [areas](/usc/16/539m–1.md?p=1-A) within the [Preserve](/usc/16/410hhh–1.md?p=7) that are adjacent to the boundaries of the [Preserve](/usc/16/410hhh–1.md?p=7) where the restriction is necessary or appropriate to protect public safety.
  - (4) **Congressional intent—** Nothing in [sections 698q to 698t](/usc/16/698q..698t.md) of this title is intended to affect the jurisdiction or responsibilities of the [State](/usc/16/6456.md?p=2) of Alabama with respect to fish and wildlife.
- (c) **Water resources projects—** Subsection (a) of [section 1278 of this title](/usc/16/1278.md) shall apply to that portion of the Little River that flows through the [Preserve](/usc/16/410hhh–1.md?p=7) in the same manner and to the same extent as such subsection applies to the rivers referred to in such subsection. The application of such subsection to the [Preserve](/usc/16/410hhh–1.md?p=7) shall not affect any determination of the value of the lands, waters, or interests in lands and waters within the boundaries of the [Preserve](/usc/16/410hhh–1.md?p=7).
- (d) **Cooperative agreements with State—**
  - (1) **Law enforcement and fire prevention—** In administering the [Preserve](/usc/16/410hhh–1.md?p=7), the [Secretary](/usc/16/410r–5.md?p=c-1) may enter into cooperative agreements with the [State](/usc/16/6456.md?p=2) of Alabama, or any political [subdivision](/usc/16/539m–1.md?p=15) of the [State](/usc/16/6456.md?p=2), for the rendering of—
    - (A) rescue, fire fighting, and law enforcement services; and
    - (B) cooperative assistance by law enforcement and fire preventive agencies located in the vicinity of the [Preserve](/usc/16/410hhh–1.md?p=7).
  - (2) **Preparation of management plan—** To facilitate the purposes of this section, the [Secretary](/usc/16/410r–5.md?p=c-1) may enter into cooperative agreements with the [State](/usc/16/6456.md?p=2) of Alabama and directly affected political [subdivisions](/usc/16/539m–1.md?p=15) of the [State](/usc/16/6456.md?p=2) to provide professional assistance in the preparation of the [management plan](/usc/16/460mmm–1.md?p=3) for the [Preserve](/usc/16/410hhh–1.md?p=7).
- (e) **DeSoto State Park—** If lands within DeSoto [State](/usc/16/6456.md?p=2) [Park](/usc/16/410r–5.md?p=c-3) are acquired by the [Secretary](/usc/16/410r–5.md?p=c-1), at the request of the Department of [Conservation](/usc/16/6456.md?p=2) and Natural [Resources](/usc/16/410hhh–1.md?p=8) of the [State](/usc/16/6456.md?p=2) of Alabama, the [Secretary](/usc/16/410r–5.md?p=c-1) shall enter into a cooperative agreement with the Department for the continued management by the Department of the lodge and other facilities that, as of October 21, 1992, are part of DeSoto [State](/usc/16/6456.md?p=2) [Park](/usc/16/410r–5.md?p=c-3). The cooperative agreement shall provide for the management and operation of the lodge and facilities in a manner that, to the maximum extent practicable, is consistent with similar operations elsewhere in the [National Park](/usc/16/410hhh–1.md?p=5) [System](/usc/16/668ee.md?p=14).
- (f) **Public involvement—**
  - (1) **Public awareness and participation program—** The [Secretary](/usc/16/410r–5.md?p=c-1) shall develop and conduct a [program](/usc/16/460ss–6.md?p=1) to promote and encourage awareness of and participation in the development of the general [management plan](/usc/16/460mmm–1.md?p=3) for the [Preserve](/usc/16/410hhh–1.md?p=7) by [persons](/usc/16/450rr–1.md?p=b) owning property in the vicinity of the [Preserve](/usc/16/410hhh–1.md?p=7), other interested groups and individuals, [State](/usc/16/6456.md?p=2), county, and municipal agencies, and the general public. Prior to final approval of the plan, the [Secretary](/usc/16/410r–5.md?p=c-1) shall hold public meetings in DeKalb and Cherokee [Counties](/usc/16/544.md?p=d).
  - (2) **Consideration of public comment—** In preparing and implementing the plan described in [paragraph (1)](#f-1), the [Secretary](/usc/16/410r–5.md?p=c-1) shall give full consideration to the views and comments of the individuals, groups, and agencies described in [paragraph (1)](#f-1).
- (g) **Green Pitcher Plant—** Upon the transfer by Alabama Power Company to the United States of any lands within the boundaries of the [Preserve](/usc/16/410hhh–1.md?p=7) that contain the Green Pitcher Plant (Sarracenia oreophila), all rights and obligations of Alabama Power Company under the agreement entered into between the company and the Department of the Interior (including the United States Fish and Wildlife Service) on May 12, 1983, in settlement of the action brought on September 24, 1980, against the [Secretary](/usc/16/410r–5.md?p=c-1) and the Director of the Fish and Wildlife Service in the United States District Court for the Northern District of Alabama (Civil Action No. CV 80–C–1242–M), shall be extinguished.

# §698s. Acquisition

- (a) **Authorization—**
  - (1) **In general—** Subject to paragraphs [(2)](#a-2) and [(3)](#a-3), the [Secretary](/usc/16/410r–5.md?p=c-1) is authorized to [acquire](/usc/16/620e.md?p=1) lands, waters, and interests in lands and waters within the boundaries of the [Preserve](/usc/16/410hhh–1.md?p=7) by donation, purchase with donated or appropriated [funds](/usc/16/1421h.md?p=2), or exchange.
  - (2) **Consent of the owner—** The [Secretary](/usc/16/410r–5.md?p=c-1) may not [acquire](/usc/16/620e.md?p=1) lands, waters, or interests in lands and waters for the [Preserve](/usc/16/410hhh–1.md?p=7) without the consent of the [owner](/usc/16/429b–3.md?p=4).
  - (3) **State lands—** Lands, waters, and interests in lands and waters within the boundaries of the [Preserve](/usc/16/410hhh–1.md?p=7) that are owned by the [State](/usc/16/6456.md?p=2) of Alabama, or any political [subdivision](/usc/16/539m–1.md?p=15) of the [State](/usc/16/6456.md?p=2), may be acquired only by donation or exchange.
- (b) **Negotiations for acquisition—**
  - (1) **Commencement of negotiations—** Immediately after publication of a description of the boundaries of the [Preserve](/usc/16/410hhh–1.md?p=7) in accordance with [section 698q(d) of this title](/usc/16/698q.md?p=d), the [Secretary](/usc/16/410r–5.md?p=c-1) shall commence negotiations for the [acquisition](/usc/16/620e.md?p=1) of the lands, waters, and interests in lands and waters within the boundaries of the [Preserve](/usc/16/410hhh–1.md?p=7).
  - (2) **Report to Congress—** Not later than 1 year after October 21, 1992, the [Secretary](/usc/16/410r–5.md?p=c-1) shall submit, in writing, a detailed schedule of actions and a progress report regarding the [acquisition](/usc/16/620e.md?p=1) to—
    - (A) the [Committee](/usc/16/941b.md?p=1) on Energy and Natural [Resources](/usc/16/410hhh–1.md?p=8) of the Senate;
    - (B) the [Committee](/usc/16/941b.md?p=1) on Natural [Resources](/usc/16/410hhh–1.md?p=8) of the House of [Representatives](/usc/16/5609.md?p=13); and
    - (C) the [Committees](/usc/16/941b.md?p=1) on Appropriations of Congress.
  - (3) **Acquisition deadline—** The [Secretary](/usc/16/410r–5.md?p=c-1) shall substantially complete the [acquisition](/usc/16/620e.md?p=1) of the lands, waters, and interests in lands and waters within the [Preserve](/usc/16/410hhh–1.md?p=7), in accordance with the purposes of [sections 698q to 698t](/usc/16/698q..698t.md) of this title, not later than 2 years after October 21, 1992, subject to the availability of [funds](/usc/16/1421h.md?p=2).
- (c) **Environmental audits—**
  - (1) **Availability to owner—** Promptly following completion of any environmental audit performed by or on behalf of the [Secretary](/usc/16/410r–5.md?p=c-1) with respect to any property proposed to be acquired for the purposes of [sections 698q to 698t](/usc/16/698q..698t.md) of this title, the [Secretary](/usc/16/410r–5.md?p=c-1) shall make available to the [owner](/usc/16/429b–3.md?p=4) of the property a copy of the audit.
  - (2) **Inclusion in documents transferring title—** Any audit described in [paragraph (1)](#c-1), and any environmental audit performed by the [owner](/usc/16/429b–3.md?p=4) of the property and submitted to the [Secretary](/usc/16/410r–5.md?p=c-1) prior to the date of the [acquisition](/usc/16/620e.md?p=1), shall be included as part of the documents transferring title to the property to the United States.
- (d) **Future additions—** No lands or interest in lands may be added to the [Preserve](/usc/16/410hhh–1.md?p=7) after October 21, 1992, without specific authorization by Congress and the consent of the [owner](/usc/16/429b–3.md?p=4) of the lands or interest.

# §698t. Authorization of appropriations


There are authorized to be appropriated such sums as are necessary to carry out [sections 698q to 698t](/usc/16/698q..698t.md) of this title.
