# §689. Tahquitz National Game Preserve


There is created within the San Bernardino [National Forest](/usc/16/5207.md?p=3) in Riverside County, California, for the protection of game animals, and as the recognized breeding place therefor, the Tahquitz National Game [Preserve](/usc/16/410hhh–1.md?p=7), which shall include the following lands: Sections 28, 29, [30](/usc/16/30.md), [31](/usc/16/31.md), [32](/usc/16/32.md), [33](/usc/16/33.md), [34](/usc/16/34.md), and [35](/usc/16/35.md), township 3 south, range 3 east, San Bernardino meridian; sections [1](/usc/16/1.md), [2](/usc/16/2.md), [3](/usc/16/3.md), [4](/usc/16/4.md), [9](/usc/16/9.md), [10](/usc/16/10.md), [11](/usc/16/11.md), [12](/usc/16/12.md), [13](/usc/16/13.md), [14](/usc/16/14.md), [15](/usc/16/15.md), [16](/usc/16/16.md), [21](/usc/16/21.md), [22](/usc/16/22.md), [23](/usc/16/23.md), [24](/usc/16/24.md), [25](/usc/16/25.md), [26](/usc/16/26.md), 27, 28, [33](/usc/16/33.md), [34](/usc/16/34.md), [35](/usc/16/35.md), and [36](/usc/16/36.md), township 4 south, range 3 east, San Bernardino meridian; and sections [1](/usc/16/1.md), [2](/usc/16/2.md), [3](/usc/16/3.md), [4](/usc/16/4.md), [9](/usc/16/9.md), [10](/usc/16/10.md), [11](/usc/16/11.md), [12](/usc/16/12.md), [13](/usc/16/13.md), [14](/usc/16/14.md), and [24](/usc/16/24.md), township 5 south, range 3 east, San Bernardino meridian; but the establishment of this reservation shall not interfere with any existing right or withdrawals made prior to July 3, 1926: Provided, That all the land with[^1] the exterior boundary of the aforesaid tract shall first become the property of the United States.

That where the Government survey has not been completed the aforesaid description shall be deemed to refer to and be determined by lines projected from the official survey.


# §689a. Other uses of land permitted in Tahquitz National Game Preserve


The lands included in said game [preserve](/usc/16/410hhh–1.md?p=7) shall continue to be parts of the [national forest](/usc/16/5207.md?p=3) and nothing contained in [sections 689 to 689d](/usc/16/689..689d.md) of this title shall prevent the [Secretary](/usc/16/410r–5.md?p=c-1) of Agriculture from permitting other [uses](/usc/16/410hhh–1.md?p=10) of said lands under and in conformity with the laws and rules and regulations applicable thereto so far as any such use may be consistent with the purposes for which said game [preserve](/usc/16/410hhh–1.md?p=7) is established.


# §689b. Hunting, pursuing, capturing in Tahquitz National Game Preserve unlawful


On lands within the game [preserve](/usc/16/410hhh–1.md?p=7) established in [section 689a of this title](/usc/16/689a.md), hunting, pursuing, poisoning, killing, or capturing by trapping, netting, or any other means, or attempting to hunt, pursue, kill, or capture any wild animals or birds for any purpose whatever upon the lands of the United States within the limits of said game [preserve](/usc/16/410hhh–1.md?p=7) shall be unlawful except as hereinafter provided.


# §689c. Rules and regulations for administration of the Tahquitz Preserve; predatory animals


The [Secretary](/usc/16/410r–5.md?p=c-1) of Agriculture shall execute the provisions of [sections 689 to 689d](/usc/16/689..689d.md) of this title, and he is authorized to make all needful rules and regulations for the administration of such game [preserves](/usc/16/410hhh–1.md?p=7) in accordance with the purposes of said sections, including regulations for hunting, capturing, or killing predatory animals, such as wolves, coyotes, cougar, and other species destructive to livestock or wildlife within the limits of said game [preserve](/usc/16/410hhh–1.md?p=7).


# §689d. Acceptance of title to privately owned lands within Tahquitz Preserve


Upon the recommendation of the [Secretary](/usc/16/410r–5.md?p=c-1) of Agriculture the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior is authorized in his discretion to accept, on behalf of the United States, title to any lands in private ownership within the boundaries of the game [preserve](/usc/16/410hhh–1.md?p=7) established, and make exchange therefor under the provisions of sections [485](/usc/16/485.md) and [486](/usc/16/486.md) of this title.
