# §6407. Coral Reef Stewardship Fund

- (a) **Agreement—** The [Administrator](/usc/16/6415.md?p=1) shall seek to enter into an agreement with the [National Fish and Wildlife Foundation](/usc/16/3743.md?p=5) (in this section referred to as the “[Foundation](/usc/16/450ss–1.md?p=1)”), authorizing the [Foundation](/usc/16/450ss–1.md?p=1) to receive, hold, and administer [funds](/usc/16/1421h.md?p=2) received under this section.
- (b) **Fund—**
  - (1) **In general—** The [Foundation](/usc/16/450ss–1.md?p=1) shall establish an account, which shall—
    - (A) be known as the “[Coral Reef](/usc/16/6415.md?p=7) [Stewardship](/usc/16/6415.md?p=23) [Fund](/usc/16/1421h.md?p=2)” (in this section referred to as the “[Fund](/usc/16/1421h.md?p=2)”); and
    - (B) serve as the successor to the account known before December 23, 2022, as the [Coral Reef](/usc/16/6415.md?p=7) [Conservation](/usc/16/6415.md?p=4) [Fund](/usc/16/1421h.md?p=2) and administered through a public-private [partnership](/usc/16/8202.md?p=7) with the [Foundation](/usc/16/450ss–1.md?p=1).
  - (2) **Deposits—** The [Foundation](/usc/16/450ss–1.md?p=1) shall deposit [funds](/usc/16/1421h.md?p=2) received under this section into the [Fund](/usc/16/1421h.md?p=2).
  - (3) **Purposes—** The [Fund](/usc/16/1421h.md?p=2) shall be available solely to support [coral reef](/usc/16/6415.md?p=7) [stewardship](/usc/16/6415.md?p=23) activities that—
    - (A) further the purposes of this chapter; and
    - (B) are consistent with—
      - (i) the [National Coral Reef Resilience Strategy](/usc/16/6415.md?p=16); and
      - (ii) [coral reef](/usc/16/6415.md?p=7) action plans in effect, if any, under [section 6404 of this title](/usc/16/6404.md) covering a [coral reef](/usc/16/6415.md?p=7) or ecologically significant component of a [coral reef](/usc/16/6415.md?p=7) to be impacted by such activities, if applicable.
  - (4) **Investment of amounts—**
    - (A) **Investment of amounts—** The [Foundation](/usc/16/450ss–1.md?p=1) shall invest such portion of the [Fund](/usc/16/1421h.md?p=2) as is not required to meet current withdrawals in interest-bearing obligations of the United States or in obligations guaranteed as to both principal and interest by the United States.
    - (B) **Interest and proceeds—** The interest on, and the proceeds from the sale or redemption of, any obligations held in the [Fund](/usc/16/1421h.md?p=2) shall be credited to and form a part of the [Fund](/usc/16/1421h.md?p=2).
  - (5) **Review of performance—** The [Administrator](/usc/16/6415.md?p=1) shall conduct a continuing review of all deposits into, and disbursements from, the [Fund](/usc/16/1421h.md?p=2). Each review shall include a written assessment concerning the extent to which the [Foundation](/usc/16/450ss–1.md?p=1) has implemented the goals and requirements of—
    - (A) this section; and
    - (B) the [National Coral Reef Resilience Strategy](/usc/16/6415.md?p=16).
- (c) **Authorization to solicit donations—**
  - (1) **In general—** Pursuant to an agreement entered into under [subsection (a)](#a), the [Foundation](/usc/16/450ss–1.md?p=1) may accept, receive, solicit, hold, administer, and use any gift (including, notwithstanding [section 1342 of title 31](/usc/31/1342.md), donations of services) to further the purposes of this chapter.
  - (2) **Deposits in Fund—** Notwithstanding [section 3302 of title 31](/usc/31/3302.md), any [funds](/usc/16/1421h.md?p=2) received as a gift shall be deposited and maintained in the [Fund](/usc/16/1421h.md?p=2).
- (d) **Administration—** Under an agreement entered into pursuant to [subsection (a)](#a), and subject to the availability of appropriations, the [Administrator](/usc/16/6415.md?p=1) may transfer [funds](/usc/16/1421h.md?p=2) appropriated for such purposes to carry out this chapter to the [Foundation](/usc/16/450ss–1.md?p=1). Amounts received by the [Foundation](/usc/16/450ss–1.md?p=1) under this subsection may be used for matching, in whole or in part, contributions (whether in money, services, or property) made to the [Foundation](/usc/16/450ss–1.md?p=1) by private [persons](/usc/16/450rr–1.md?p=b), [State](/usc/16/6415.md?p=22) or local government agencies, or [covered Native entities](/usc/16/6415.md?p=10).
