# §470dd. Custody of archaeological resources


The [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior may promulgate regulations providing for—

- (1) the exchange, where appropriate, between suitable universities, museums, or other scientific or educational institutions, of archaeological [resources](/usc/16/410hhh–1.md?p=8) removed from [public lands](/usc/16/470bb.md?p=3) and [Indian lands](/usc/16/470bb.md?p=4) pursuant to this chapter, and
- (2) the ultimate disposition of such [resources](/usc/16/410hhh–1.md?p=8) and other [resources](/usc/16/410hhh–1.md?p=8) removed pursuant to chapter 3125 or [chapter 3203](/usc/54/chstIII-dC-ch3203.md) of title 54.

Any exchange or ultimate disposition under such regulation of archaeological [resources](/usc/16/410hhh–1.md?p=8) excavated or removed from [Indian lands](/usc/16/470bb.md?p=4) shall be subject to the consent of the Indian or [Indian tribe](/usc/16/470bb.md?p=5) which owns or has jurisdiction over such lands. Following promulgation of regulations under this section, notwithstanding any other provision of law, such regulations shall govern the disposition of archaeological [resources](/usc/16/410hhh–1.md?p=8) removed from [public lands](/usc/16/470bb.md?p=3) and [Indian lands](/usc/16/470bb.md?p=4) pursuant to this chapter.
