# §424c. Moccasin Bend National Archeological District

- (a) **Short title—** This section may be cited as the “Moccasin Bend National Archeological District Act”.
- (b) **Definitions—** As used in this section:
  - (1) **Secretary—** The term “Secretary” means the Secretary of the Interior.
  - (2) **Archeological district—** The term “archeological district” means the Moccasin Bend National Archeological District.
  - (3) **State—** The term “State” means the State of Tennessee.
  - (4) **Map—** The term “Map” means the map entitled, “Boundary Map Moccasin Bend National Archeological District”, numbered 301/80098, and dated September 2002.
- (c) **Establishment—**
  - (1) **In general—** In order to [preserve](/usc/16/410hhh–1.md?p=7), protect, and interpret for the benefit of the public the nationally significant archeological and historic [resources](/usc/16/410hhh–1.md?p=8) located on the peninsula known as Moccasin Bend, Tennessee, there is established as a [unit](/usc/16/430f–7.md?p=4) of Chickamauga and Chattanooga National Military [Park](/usc/16/410r–5.md?p=c-3), the Moccasin Bend National [Archeological District](#b-2).
  - (2) **Boundaries—** The [archeological district](#b-2) shall consist of approximately 780 acres generally depicted on the [Map](#b-4). The [Map](#b-4) shall be on file and available for public inspection in the appropriate offices of the [National Park](/usc/16/410hhh–1.md?p=5) Service, Department of the Interior.
  - (3) **Acquisition of land and interests in land—**
    - (A) **In general—** The [Secretary](#b-1) may [acquire](/usc/16/620e.md?p=1) by donation, purchase from willing sellers using donated or appropriated [funds](/usc/16/1421h.md?p=2), or exchange, lands and interests in lands within the exterior boundary of the [archeological district](#b-2). The [Secretary](#b-1) may [acquire](/usc/16/620e.md?p=1) the [State](#b-3), county and city-owned land and interests in land for inclusion in the [archeological district](#b-2) only by donation.
    - (B) **Easement outside boundary—** To allow access between [areas](/usc/16/539m–1.md?p=1-A) of the [archeological district](#b-2) that on February 20, 2003, are noncontiguous, the [Secretary](#b-1) may [acquire](/usc/16/620e.md?p=1) by donation or purchase from willing [owners](/usc/16/429b–3.md?p=4) using donated or appropriated [funds](/usc/16/1421h.md?p=2), or exchange, easements connecting the [areas](/usc/16/539m–1.md?p=1-A) generally depicted on the [Map](#b-4).
- (d) **Administration—**
  - (1) **In general—** The [archeological district](#b-2) shall be administered by the [Secretary](#b-1) in accordance with this section, with laws applicable to Chickamauga and Chattanooga National Military [Park](/usc/16/410r–5.md?p=c-3), and with the laws generally applicable to [units](/usc/16/430f–7.md?p=4) of the [National Park](/usc/16/410hhh–1.md?p=5) [System](/usc/16/668ee.md?p=14).
  - (2) **Cooperative agreement—** The [Secretary](#b-1) may consult and enter into cooperative agreements with culturally affiliated federally recognized [Indian tribes](/usc/16/544.md?p=g), governmental entities, and interested [persons](/usc/16/450rr–1.md?p=b) to provide for the [restoration](/usc/16/6456.md?p=2), preservation, development, interpretation, and use of the [archeological district](#b-2).
  - (3) **Visitor interpretive center—** For purposes of interpreting the historical themes and cultural [resources](/usc/16/410hhh–1.md?p=8) of the [archeological district](#b-2), the [Secretary](#b-1) may establish and administer a visitor center in the [archeological district](#b-2).
  - (4) **General management plan—** Not later than 3 years after [funds](/usc/16/1421h.md?p=2) are made available under this section, the [Secretary](#b-1) shall develop a general [management plan](/usc/16/460mmm–1.md?p=3) for the [archeological district](#b-2). The general [management plan](/usc/16/460mmm–1.md?p=3) shall describe the appropriate protection and preservation of natural, cultural, and scenic [resources](/usc/16/410hhh–1.md?p=8), visitor use, and facility development within the [archeological district](#b-2) consistent with the purposes of this section, while ensuring continued access by private landowners to their property.
