# §3334. Review of State program by Secretary

- (a) **In general—** The [Secretary](/usc/16/410r–5.md?p=c-1) shall conduct a continuing review of the [State](/usc/16/6456.md?p=2) [program](/usc/16/460ss–6.md?p=1) to determine whether the [program](/usc/16/460ss–6.md?p=1) remains consistent with this chapter or other applicable law. Such review shall include a biennial audit of the rec­ords of the [State](/usc/16/6456.md?p=2) [program](/usc/16/460ss–6.md?p=1).
- (b) **Action upon finding of noncompliance—** If the [Secretary](/usc/16/410r–5.md?p=c-1) finds that the [program](/usc/16/460ss–6.md?p=1) or the administration thereof is no longer in compliance with this subchapter, he shall reduce or discontinue distribution of [funds](/usc/16/1421h.md?p=2) under this subchapter, or take other appropriate action.
- (c) **Disposition of certain moneys—** If the [Secretary](/usc/16/410r–5.md?p=c-1) finds that any money provided to the [State](/usc/16/6456.md?p=2) or obtained by the [State](/usc/16/6456.md?p=2) from the resale of any [fishing](/usc/16/7901.md?p=b) or [charter vessel](/usc/16/3302.md?p=2) purchased under the [program](/usc/16/460ss–6.md?p=1) is not being used in accordance with the provisions of this subchapter, the [Secretary](/usc/16/410r–5.md?p=c-1) shall recover from the [fund](/usc/16/1421h.md?p=2), and place in the United States Treasury, such moneys.
