# §652. Central European Enterprise Development Commission

- (a) **Establishment—** There is hereby established a Central European [Small Business](/usc/15/1691c–2.md?p=h-2) Enterprise Development [Commission](/usc/15/78c.md?p=a-15) (hereinafter in this section referred to as the “[Commission](/usc/15/78c.md?p=a-15)”). The [Commission](/usc/15/78c.md?p=a-15) shall be comprised of a representative of each of the following: the [Small Business](/usc/15/1691c–2.md?p=h-2) [Administration](/usc/15/636e.md?p=1), the [Association](/usc/15/657h.md?p=a-2) of American Universities, and the [Association](/usc/15/657h.md?p=a-2) of [Small Business Development Centers](/usc/15/632.md?p=t).
- (b) **Management and technical assistance to designated Central European countries—** The [Commission](/usc/15/78c.md?p=a-15) shall develop in Czechoslovakia, Poland and Hungary (hereinafter referred to as “designated Central European countries”) a self-sustaining system to provide management and technical assistance to [small business](/usc/15/1691c–2.md?p=h-2) owners.
  - (1) Not later than 90 days after November 5, 1990, the [Commission](/usc/15/78c.md?p=a-15), in consultation with the [Agency](/usc/15/632.md?p=b) for International Development, shall enter[^1] a contract with one or more entities to—
    - (A) determine the needs of [small businesses](/usc/15/1691c–2.md?p=h-2) in the designated Central European countries for management and technical assistance;
    - (B) evaluate appropriate [Small Business Development Center](/usc/15/632.md?p=t)-[programs](/usc/15/2921.md?p=6) which might be replicated in [order](/usc/15/8702.md?p=14) to meet the needs of each of such countries; and
    - (C) identify and assess the capability of educational institutions in each such country to develop a [Small Business Development Center](/usc/15/632.md?p=t) type [program](/usc/15/2921.md?p=6).
  - (2) Not later than 18 months after November 5, 1990, the [Commission](/usc/15/78c.md?p=a-15) shall review the recommendations submitted to it and shall formulate and contract for the establishment of a three-year management and technical assistance demonstration [program](/usc/15/2921.md?p=6).
- (c) **Eligibility—** In [order](/usc/15/8702.md?p=14) to be eligible to participate, the educational institution in each designated Central European country shall—
  - (1) obtain the prior approval of the government to conduct the [program](/usc/15/2921.md?p=6);
  - (2) agree to provide partial financial support for the [program](/usc/15/2921.md?p=6), either directly or indirectly, during the second and third years of the demonstration [program](/usc/15/2921.md?p=6); and
  - (3) agree to obtain private sector involvement in the delivery of assistance under the [program](/usc/15/2921.md?p=6).
- (d) **Initial meeting and organization—** The [Commission](/usc/15/78c.md?p=a-15) shall meet and organize not later than 30 days after November 5, 1990.
- (e) **Reimbursement for necessary expenses—** Members of the [Commission](/usc/15/78c.md?p=a-15) shall serve without pay, except they shall be entitled to reimbursement for travel, subsistence, and other necessary expenses incurred by them in carrying out their functions in the same manner as [persons](/usc/15/78m.md?p=h-8-E) employed intermittently in the Federal Government are allowed expenses under [section 5703 of title 5](/usc/5/5703.md).
- (f) **Meetings; quorum—** Two Commissioners shall constitute a quorum for the transaction of business. Meetings shall be at the call of the Chairperson who shall be elected by the Members of the [Commission](/usc/15/78c.md?p=a-15).
- (g) **Authority; personnel—** The [Commission](/usc/15/78c.md?p=a-15) shall not have any [authority](/usc/15/3051.md?p=1) to appoint staff, but upon request of the Chairperson, the head of any Federal department or [agency](/usc/15/632.md?p=b) may detail, on a reimbursable basis, any of the personnel of such department or [agency](/usc/15/632.md?p=b) to the [Commission](/usc/15/78c.md?p=a-15) to assist in carrying out the [Commission](/usc/15/78c.md?p=a-15)’s functions under this section without regard to [section 3341 of title 5](/usc/5/3341.md). The [Administrator](/usc/15/637c.md?p=1) of the General Services [Administration](/usc/15/636e.md?p=1) shall provide, on a reimbursable basis, such administrative support services as the [Commission](/usc/15/78c.md?p=a-15) may request.
- (h) **Initial and annual reports to Congress—** The [Commission](/usc/15/78c.md?p=a-15) shall report to Congress not later than December 1, 1991, and annually thereafter, on the progress in carrying out the provisions of this section.
- (i) **Authorization of appropriations—** There are hereby authorized to be appropriated to the [Small Business](/usc/15/1691c–2.md?p=h-2) [Administration](/usc/15/636e.md?p=1) the sum of $3,000,000 for fiscal year 1991, $5,000,000 for fiscal year 1992, $2,000,000 for each of fiscal years 1993 and 1994, and $1,000,000 for fiscal year 1995 to carry out the provisions of this section. Such sums shall be disbursed by the [Small Business](/usc/15/1691c–2.md?p=h-2) [Administration](/usc/15/636e.md?p=1) as requested by the [Commission](/usc/15/78c.md?p=a-15) and may remain available until expended. Any [authority](/usc/15/3051.md?p=1) to enter contracts or other spending [authority](/usc/15/3051.md?p=1) provided for in this section is subject to amounts provided for in advance in appropriations Acts.
