# §633. Retirement for years of service: regular and Space Force lieutenant colonels; regular Navy commanders

- (a) **28 Years of Active Commissioned Service.—**
  - (1) Except as provided in [subsection (b)](#b) and as provided under section [637(b)](/usc/10/637.md?p=b) or [637a](/usc/10/637a.md) of this title, each [officer](/usc/10/101.md?p=b-1) of the [Regular](/usc/10/101.md?p=b-12) [Army](/usc/10/7001.md), [Regular](/usc/10/101.md?p=b-12) Air Force, or [Regular](/usc/10/101.md?p=b-12) Marine Corps who holds the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of lieutenant colonel, and each [officer](/usc/10/101.md?p=b-1) of the [Regular](/usc/10/101.md?p=b-12) Navy who holds the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of commander, who is not on a list of [officers](/usc/10/101.md?p=b-1) recommended for promotion to the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of colonel or captain, respectively, shall, if not earlier retired, be retired on the first day of the month after the month in which he completes 28 years of active commissioned service.
  - (2) Except as provided under section [637(b)](/usc/10/637.md?p=b) or [637a](/usc/10/637a.md) of this title, each [officer](/usc/10/101.md?p=b-1) of the Space Force who holds the [grade](/usc/10/101.md?p=b-7) of lieutenant colonel who is not on a list of [officers](/usc/10/101.md?p=b-1) recommended for promotion to the [grade](/usc/10/101.md?p=b-7) of colonel shall, if not earlier retired, be retired on the first day of the month after the month in which the [officer](/usc/10/101.md?p=b-1) completes 28 years of active commissioned service.
- (b) **Exceptions.—** [Subsection (a)](#a) does not apply to the following:
  - (1) An [officer](/usc/10/101.md?p=b-1) of the Navy or Marine Corps who is an [officer](/usc/10/101.md?p=b-1) designated for limited duty to whom section [8146(e)](/usc/10/8146.md?p=e) or [8372](/usc/10/8372.md) of this title applies.
  - (2) An [officer](/usc/10/101.md?p=b-1) of the Navy or Marine Corps who is a permanent professor at the [United States](/usc/10/101.md?p=a-1) Naval Academy.

# §634. Retirement for years of service: regular and Space Force colonels; regular Navy captains

- (a) **30 Years of Active Commissioned Service.—**
  - (1) Except as provided in [subsection (b)](#b) and as provided under section [637(b)](/usc/10/637.md?p=b) or [637a](/usc/10/637a.md) of this title, each [officer](/usc/10/101.md?p=b-1) of the [Regular](/usc/10/101.md?p=b-12) [Army](/usc/10/7001.md), [Regular](/usc/10/101.md?p=b-12) Air Force, or [Regular](/usc/10/101.md?p=b-12) Marine Corps who holds the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of colonel, and each [officer](/usc/10/101.md?p=b-1) of the [Regular](/usc/10/101.md?p=b-12) Navy who holds the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of captain, who is not on a list of [officers](/usc/10/101.md?p=b-1) recommended for promotion to the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of brigadier general or rear admiral (lower half), respectively, shall, if not earlier retired, be retired on the first day of the month after the month in which he completes 30 years of active commissioned service.
  - (2) Except as provided under section [637(b)](/usc/10/637.md?p=b) or [637a](/usc/10/637a.md) of this title, each [officer](/usc/10/101.md?p=b-1) of the Space Force who holds the [grade](/usc/10/101.md?p=b-7) of colonel who is not on a list of [officers](/usc/10/101.md?p=b-1) recommended for promotion to the [grade](/usc/10/101.md?p=b-7) of brigadier general shall, if not earlier retired, be retired on the first day of the month after the month in which the [officer](/usc/10/101.md?p=b-1) completes 30 years of active commissioned service.
- (b) **Exceptions.—** [Subsection (a)](#a) does not apply to the following:
  - (1) An [officer](/usc/10/101.md?p=b-1) of the Navy who is designated for limited duty to whom [section 8372(a)(4) of this title](/usc/10/8372.md?p=a-4) applies.
  - (2) An [officer](/usc/10/101.md?p=b-1) of the Navy or Marine Corps who is a permanent professor at the [United States](/usc/10/101.md?p=a-1) Naval Academy.

# §635. Retirement for years of service: regular and Space Force brigadier generals; regular Navy rear admirals (lower half)

- (a) **Army, Navy, Air Force, and Marine Corps.—** Except as provided under section [637(b)](/usc/10/637.md?p=b) or [637a](/usc/10/637a.md) of this title, each [officer](/usc/10/101.md?p=b-1) of the [Regular](/usc/10/101.md?p=b-12) [Army](/usc/10/7001.md), [Regular](/usc/10/101.md?p=b-12) Air Force, or [Regular](/usc/10/101.md?p=b-12) Marine Corps who holds the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of brigadier general, and each [officer](/usc/10/101.md?p=b-1) of the [Regular](/usc/10/101.md?p=b-12) Navy who holds the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of rear admiral (lower half), who is not on a list of [officers](/usc/10/101.md?p=b-1) recommended for promotion to the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of major general or rear admiral, respectively, shall, if not earlier retired, be retired on the first day of the first month beginning after the date of the fifth anniversary of his appointment to that [grade](/usc/10/101.md?p=b-7) or on the first day of the month after the month in which he completes 30 years of active commissioned service, whichever is later.
- (b) **Space Force.—** Except as provided under section [637(b)](/usc/10/637.md?p=b) or [637a](/usc/10/637a.md) of this title, each [officer](/usc/10/101.md?p=b-1) of the Space Force who holds the [grade](/usc/10/101.md?p=b-7) of brigadier general who is not on a list of [officers](/usc/10/101.md?p=b-1) recommended for promotion to the [grade](/usc/10/101.md?p=b-7) of major general shall, if not earlier retired, be retired as specified in [subsection (a)](#a).

# §636. Retirement for years of service: regular and Space Force officers in grades above brigadier general; regular Navy officers in grades above rear admiral (lower half)

- (a) **Major Generals and Rear Admirals Serving in Grade.—**
  - (1) Except as provided in subsection [(b)](#b) or [(c)](#c) and under section [637(b)](/usc/10/637.md?p=b) or [637a](/usc/10/637a.md) of this title, each [officer](/usc/10/101.md?p=b-1) of the [Regular](/usc/10/101.md?p=b-12) [Army](/usc/10/7001.md), [Regular](/usc/10/101.md?p=b-12) Air Force, or [Regular](/usc/10/101.md?p=b-12) Marine Corps who holds the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of major general, and each [officer](/usc/10/101.md?p=b-1) of the [Regular](/usc/10/101.md?p=b-12) Navy who holds the [regular](/usc/10/101.md?p=b-12) [grade](/usc/10/101.md?p=b-7) of rear admiral, shall, if not earlier retired, be retired on the first day of the first month beginning after the date of the fifth anniversary of his appointment to that [grade](/usc/10/101.md?p=b-7) or on the first day of the month after the month in which he completes 35 years of active commissioned service, whichever is later.
  - (2) Except as provided in subsection [(b)](#b) or [(c)](#c) and under section [637(b)](/usc/10/637.md?p=b) or [637a](/usc/10/637a.md) of this title, each [officer](/usc/10/101.md?p=b-1) of the Space Force who holds the [grade](/usc/10/101.md?p=b-7) of major general shall, if not earlier retired, be retired as specified in [paragraph (1)](#a-1).
- (b) **Lieutenant Generals and Vice Admirals.—** In the administration of [subsection (a)](#a) in the case of an [officer](/usc/10/101.md?p=b-1) who is serving in the [grade](/usc/10/101.md?p=b-7) of lieutenant general or vice admiral, the number of years of active commissioned service applicable to the [officer](/usc/10/101.md?p=b-1) is 38 years.
- (c) **Generals and Admirals.—** In the administration of [subsection (a)](#a) in the case of an [officer](/usc/10/101.md?p=b-1) who is serving in the [grade](/usc/10/101.md?p=b-7) of general or admiral, the number of years of active commissioned service applicable to the [officer](/usc/10/101.md?p=b-1) is 40 years.
