# §10301. Reserve Forces Policy Board

- (a) **In General.—** As provided in [section 175 of this title](/usc/10/175.md), there is in the Office of the Secretary of Defense a board known as the “[Reserve](/usc/10/101.md?p=c-6) Forces Policy Board” (in this section referred to as the “Board”).
- (b) **Functions.—** The Board shall serve as an independent adviser to the Secretary of Defense to provide advice and recommendations to the Secretary on strategies, policies, and practices designed to improve and enhance the capabilities, efficiency, and effectiveness of the [reserve](/usc/10/101.md?p=c-6) components.
- (c) **Membership.—** The Board consists of 20 [members](/usc/10/1408.md?p=a-5), appointed or designated as follows:
  - (1) A civilian appointed by the Secretary of Defense from among persons determined by the Secretary to have the knowledge of, and experience in, policy matters relevant to national security and [reserve](/usc/10/101.md?p=c-6) component matters necessary to carry out the duties of chair of the Board, who shall serve as chair of the Board.
  - (2) Two active or retired [reserve](/usc/10/101.md?p=c-6) [officers](/usc/10/101.md?p=b-1) or [enlisted members](/usc/10/101.md?p=b-6) designated by the Secretary of Defense upon the recommendation of the Secretary of the [Army](/usc/10/7001.md)—
    - (A) one of whom shall be a [member](/usc/10/1408.md?p=a-5) of the [Army National Guard of the United States](/usc/10/101.md?p=c-3) or a former [member](/usc/10/1408.md?p=a-5) of the [Army National Guard of the United States](/usc/10/101.md?p=c-3) in the Retired [Reserve](/usc/10/101.md?p=c-6); and
    - (B) one of whom shall be a [member](/usc/10/1408.md?p=a-5) or retired [member](/usc/10/1408.md?p=a-5) of the [Army](/usc/10/7001.md) [Reserve](/usc/10/101.md?p=c-6).
  - (3) Two active or retired [reserve](/usc/10/101.md?p=c-6) [officers](/usc/10/101.md?p=b-1) or [enlisted members](/usc/10/101.md?p=b-6) designated by the Secretary of Defense upon the recommendation of the Secretary of the Navy—
    - (A) one of whom shall be an active or retired [officer](/usc/10/101.md?p=b-1) of the Navy [Reserve](/usc/10/101.md?p=c-6); and
    - (B) one of whom shall be an active or retired [officer](/usc/10/101.md?p=b-1) of the Marine Corps [Reserve](/usc/10/101.md?p=c-6).
  - (4) Two active or retired [reserve](/usc/10/101.md?p=c-6) [officers](/usc/10/101.md?p=b-1) or [enlisted members](/usc/10/101.md?p=b-6) designated by the Secretary of Defense upon the recommendation of the Secretary of the Air Force—
    - (A) one of whom shall be a [member](/usc/10/1408.md?p=a-5) of the [Air National Guard of the United States](/usc/10/101.md?p=c-5) or a former [member](/usc/10/1408.md?p=a-5) of the [Air National Guard of the United States](/usc/10/101.md?p=c-5) in the Retired [Reserve](/usc/10/101.md?p=c-6); and
    - (B) one of whom shall be a [member](/usc/10/1408.md?p=a-5) or retired [member](/usc/10/1408.md?p=a-5) of the Air Force [Reserve](/usc/10/101.md?p=c-6).
  - (5) One active or retired [reserve](/usc/10/101.md?p=c-6) [officer](/usc/10/101.md?p=b-1) or [enlisted member](/usc/10/101.md?p=b-6) of the Coast Guard designated by the Secretary of Homeland Security.
  - (6) Ten persons appointed or designated by the Secretary of Defense, each of whom shall be a [United States](/usc/10/101.md?p=a-1) citizen having significant knowledge of and experience in policy matters relevant to national security and [reserve](/usc/10/101.md?p=c-6) component matters and shall be one of the following:
    - (A) An individual not employed in any Federal or State department or [agency](/usc/10/4701.md?p=g-1).
    - (B) An individual employed by a Federal or State department or [agency](/usc/10/4701.md?p=g-1).
    - (C) An [officer](/usc/10/101.md?p=b-1) of a [regular](/usc/10/101.md?p=b-12) component of the [armed forces](/usc/10/101.md?p=a-4) on [active duty](/usc/10/101.md?p=d-1), or an [officer](/usc/10/101.md?p=b-1) of a [reserve](/usc/10/101.md?p=c-6) component of the [armed forces](/usc/10/101.md?p=a-4) in an [active status](/usc/10/101.md?p=d-4), who—
      - (i) is serving or has served in a senior position on the Joint Staff, the headquarters staff of a combatant command, or the headquarters staff of an armed force; and
      - (ii) has experience in joint professional military education, joint qualification, and joint operations matters.
  - (7) A [reserve](/usc/10/101.md?p=c-6) [officer](/usc/10/101.md?p=b-1) of the [Army](/usc/10/7001.md), Navy, Air Force, or Marine Corps who is a general or [flag officer](/usc/10/101.md?p=b-5) recommended by the chair and designated by the Secretary of Defense, who shall serve without vote—
    - (A) as military adviser to the chair;
    - (B) as military executive [officer](/usc/10/101.md?p=b-1) of the Board; and
    - (C) as supervisor of the operations and staff of the Board.
  - (8) A senior [enlisted member](/usc/10/101.md?p=b-6) of a [reserve](/usc/10/101.md?p=c-6) component recommended by the chair and designated by the Secretary of Defense, who shall serve without vote as enlisted military adviser to the chair.
- (d) **Matters To Be Acted on.—** The Board may act on those matters referred to it by the chair and on any matter raised by a [member](/usc/10/1408.md?p=a-5) of the Board or the Secretary of Defense.
- (e) **Staff.—** The Board shall be supported by a staff consisting of one full-time [officer](/usc/10/101.md?p=b-1) from each of the [reserve](/usc/10/101.md?p=c-6) components listed in paragraphs (1) through (6) of [section 10101 of this title](/usc/10/10101.md) who holds the [grade](/usc/10/101.md?p=b-7) of colonel (or in the case of the Navy, the [grade](/usc/10/101.md?p=b-7) of captain) or who has been selected for promotion to that [grade](/usc/10/101.md?p=b-7). These [officers](/usc/10/101.md?p=b-1) shall also serve as liaisons between their respective components and the Board. They shall perform their staff and liaison duties under the supervision of the military executive [officer](/usc/10/101.md?p=b-1) of the Board in an independent manner reflecting the independent nature of the Board.
- (f) **Relationship to Service Reserve Policy Committees and Boards.—** This section does not affect the committees and boards prescribed within the [military departments](/usc/10/101.md?p=a-8) by [sections 10302 through 10305](/usc/10/10302..10305.md) of this title, and a [member](/usc/10/1408.md?p=a-5) of such a committee or board may, if otherwise eligible, be a [member](/usc/10/1408.md?p=a-5) of the Board.

# §10302. Army Reserve Forces Policy Committee

- (a) There is in the Office of the Secretary of the [Army](/usc/10/7001.md) an [Army](/usc/10/7001.md) [Reserve](/usc/10/101.md?p=c-6) Forces Policy Committee. The Committee shall review and comment upon major policy matters directly affecting the [reserve](/usc/10/101.md?p=c-6) components and the mobilization preparedness of the [Army](/usc/10/7001.md). The Committee’s comments on such policy matters shall accompany the final report regarding any such matters submitted to the Secretary of the [Army](/usc/10/7001.md) and the Chief of Staff.
- (b) The Committee consists of [officers](/usc/10/101.md?p=b-1) in the [grade](/usc/10/101.md?p=b-7) of colonel or above, as follows:
  - (1) five [members](/usc/10/1408.md?p=a-5) of the [Regular](/usc/10/101.md?p=b-12) [Army](/usc/10/7001.md) on duty with the [Army](/usc/10/7001.md) General Staff;
  - (2) five [members](/usc/10/1408.md?p=a-5) of the [Army National Guard of the United States](/usc/10/101.md?p=c-3); and
  - (3) five [members](/usc/10/1408.md?p=a-5) of the [Army](/usc/10/7001.md) [Reserve](/usc/10/101.md?p=c-6).
- (c) The [members](/usc/10/1408.md?p=a-5) of the Committee shall select the Chairman from among the [members](/usc/10/1408.md?p=a-5) of the [reserve](/usc/10/101.md?p=c-6) components on the Committee.
- (d) A majority of the [members](/usc/10/1408.md?p=a-5) of the Committee shall act whenever matter affecting both the [Army National Guard of the United States](/usc/10/101.md?p=c-3) and [Army](/usc/10/7001.md) [Reserve](/usc/10/101.md?p=c-6) are being considered. However, when any matter solely affecting one of the [reserve](/usc/10/101.md?p=c-6) components of the [Army](/usc/10/7001.md) is being considered, it shall be acted upon only by the Subcommittee on [Army National Guard](/usc/10/101.md?p=c-2) Policy or the Subcommittee on [Army](/usc/10/7001.md) [Reserve](/usc/10/101.md?p=c-6) Policy, as appropriate.
- (e) The Subcommittee on [Army National Guard](/usc/10/101.md?p=c-2) Policy consists of the [members](/usc/10/1408.md?p=a-5) of the Committee other than the [Army](/usc/10/7001.md) [Reserve](/usc/10/101.md?p=c-6) [members](/usc/10/1408.md?p=a-5).
- (f) The Subcommittee on [Army](/usc/10/7001.md) [Reserve](/usc/10/101.md?p=c-6) Policy consists of the [members](/usc/10/1408.md?p=a-5) of the Committee other than the [Army National Guard](/usc/10/101.md?p=c-2) [members](/usc/10/1408.md?p=a-5).
- (g) Membership on the Committee is determined by the Secretary of the [Army](/usc/10/7001.md) and is for a minimum period of three years. Except in the case of [members](/usc/10/1408.md?p=a-5) of the Committee from the [Regular](/usc/10/101.md?p=b-12) [Army](/usc/10/7001.md), the Secretary of the [Army](/usc/10/7001.md), when appointing new [members](/usc/10/1408.md?p=a-5), shall insure that among the [officers](/usc/10/101.md?p=b-1) of each component on the Committee there will at all times be two or more [members](/usc/10/1408.md?p=a-5) with more than one year of continuous service on the Committee.
- (h) There shall be not less than 10 [officers](/usc/10/101.md?p=b-1) of the [Army National Guard of the United States](/usc/10/101.md?p=c-3) and the [Army](/usc/10/7001.md) [Reserve](/usc/10/101.md?p=c-6) on duty with the [Army](/usc/10/7001.md) Staff, one-half of whom shall be from each of those components. These [officers](/usc/10/101.md?p=b-1) shall be considered as additional [members](/usc/10/1408.md?p=a-5) of the [Army](/usc/10/7001.md) Staff while on that duty.

# §10303. Navy Reserve Policy Board


A Navy [Reserve](/usc/10/101.md?p=c-6) Policy Board shall be convened at least once annually at the seat of government to consider, recommend, and report to the Secretary of the Navy on [reserve](/usc/10/101.md?p=c-6) policy matters. At least half of the [members](/usc/10/1408.md?p=a-5) of the Board must be [officers](/usc/10/101.md?p=b-1) of the Navy [Reserve](/usc/10/101.md?p=c-6).


# §10304. Marine Corps Reserve Policy Board


A Marine Corps [Reserve](/usc/10/101.md?p=c-6) Policy Board shall be convened at least once annually at the seat of government to consider, recommend, and report to the Secretary of the Navy on [reserve](/usc/10/101.md?p=c-6) policy matters. At least half of the [members](/usc/10/1408.md?p=a-5) of the Board must be [officers](/usc/10/101.md?p=b-1) of the Marine Corps [Reserve](/usc/10/101.md?p=c-6).


# §10305. Air Force Reserve Forces Policy Committee

- (a) There is in the Office of the Secretary of the Air Force an Air [Reserve](/usc/10/101.md?p=c-6) Forces Policy Committee on [Air National Guard](/usc/10/101.md?p=c-4) and Air Force [Reserve](/usc/10/101.md?p=c-6) Policy. The Committee shall review and comment upon major policy matters directly affecting the [reserve](/usc/10/101.md?p=c-6) components and the mobilization preparedness of the Air Force. The Committee’s comments on such policy matters shall accompany the final report regarding any such matters submitted to the Secretary of the Air Force and the Chief of Staff.
- (b)
  - (1) The committee shall have voting [members](/usc/10/1408.md?p=a-5), who shall be [officers](/usc/10/101.md?p=b-1) in the [grade](/usc/10/101.md?p=b-7) of colonel or above, as follows:
    - (A) five [members](/usc/10/1408.md?p=a-5) of the [Regular](/usc/10/101.md?p=b-12) Air Force on duty with the Air Staff;
    - (B) five [members](/usc/10/1408.md?p=a-5) of the [Air National Guard of the United States](/usc/10/101.md?p=c-5); and
    - (C) five [members](/usc/10/1408.md?p=a-5) of the Air Force [Reserve](/usc/10/101.md?p=c-6).
  - (2)
    - (A) The committee shall have four nonvoting [members](/usc/10/1408.md?p=a-5), who shall be the Chief Master Sergeants of the Air Force, the Air Force [Reserve](/usc/10/101.md?p=c-6), the [Air National Guard](/usc/10/101.md?p=c-4), and the Space Force.
    - (B) A nonvoting [member](/usc/10/1408.md?p=a-5) who cannot attend a meeting of the committee may designate a [member](/usc/10/1408.md?p=a-5) in the [grade](/usc/10/101.md?p=b-7) of E–8 or E–9 to attend in their stead.
- (c) The [members](/usc/10/1408.md?p=a-5) of the Committee shall select the Chairman from among the [members](/usc/10/1408.md?p=a-5) of the [reserve](/usc/10/101.md?p=c-6) components on the Committee.
- (d) A majority of the [members](/usc/10/1408.md?p=a-5) of the Committee shall act whenever matters affecting both the [Air National Guard of the United States](/usc/10/101.md?p=c-5) and Air Force [Reserve](/usc/10/101.md?p=c-6) are being considered. However, when any matter solely affecting one of the Air Force [Reserve](/usc/10/101.md?p=c-6) components is being considered, it shall be acted upon only by the Subcommittee on [Air National Guard](/usc/10/101.md?p=c-4) Policy or the Subcommittee on Air Force [Reserve](/usc/10/101.md?p=c-6) Policy, as appropriate.
- (e) The Subcommittee on [Air National Guard](/usc/10/101.md?p=c-4) Policy consists of the [members](/usc/10/1408.md?p=a-5) of the Committee other than the Air Force [Reserve](/usc/10/101.md?p=c-6) [members](/usc/10/1408.md?p=a-5).
- (f) The Subcommittee on Air Force [Reserve](/usc/10/101.md?p=c-6) Policy consists of the [members](/usc/10/1408.md?p=a-5) of the Committee other than the [Air National Guard](/usc/10/101.md?p=c-4) [members](/usc/10/1408.md?p=a-5).
- (g) Membership on the Air Staff Committee is determined by the Secretary of the Air Force and is for a minimum period of three years. Except in the case of [members](/usc/10/1408.md?p=a-5) of the Committee from the [Regular](/usc/10/101.md?p=b-12) Air Force, the Secretary of the Air Force, when appointing new [members](/usc/10/1408.md?p=a-5), shall insure that among the [officers](/usc/10/101.md?p=b-1) of each component on the Committee there will at all times be two or more [members](/usc/10/1408.md?p=a-5) with more than one year of continuous service on the Committee.
